Salem Man Sentenced to 6.5 to 8 Years for Rape
Rafael Nina Brito, 22, who was found guilty on March 30th of rape, was sentenced today to six and half to eight years in state prison by Judge John Lu in Salem Superior Court.
Essex Assitant District Attorney Greg Friedholm proved that on February 15, 2008, Nina Brito, along with 3 others, offered a 17 year-old Salem girl a ride home from a basketball game. Instead he took her to his mother’s apartment in Lynn where he raped her.
Friedholm recommended seven to eight years in state prison while defense attorney William Martin requested one to two and half years.
Two of the other men, Luis Arias, 22 and Justin Louf, 21, both of Salem, pleaded guilty to aggravated rape on March 22 in Salem Superior Court.
A fourth co-defendant, Harold Baltodano, 22, of Lynn will go on trial on June 20, 2012 for aggravated rape. He is presumed innocent of the charges until proven guilty in a court of law.
