Pursuant to Section 7 of Chapter 150E of the General Laws, I submit for your consideration appropriation recommendations to fund the Fiscal Year 2007 and 2008 incremental costs contained in collective bargaining agreements between the:

Commonwealth and the

o American Federation of State, County and Municipal Employees (Unit 2),
o Service Employees International Union, Local 509 (Units 8 & 10),
o Massachusetts Correction Officers Federated Union (Unit 4A), and
o Massachusetts Organization of State Engineers and Scientists (Unit 9).

Franklin sheriff's department and the

o International Brotherhood of Teamsters, Local 404, and
o Non-Unit Employees Association.

Berkshire sheriff's department and the

o International Brotherhood of Correctional Officers, Local R1-297, and
o Berkshire County Sheriff's Office Employees' Association

Essex sheriff's department and the

o International Brotherhood of Correctional Officers, Local R1-27
o Essex County Correctional Officers Association, and

This legislation places a total of $100,607,103 in 20 reserves from which funds may be transferred to departments' operating accounts to meet the Fiscal Year 2007 and 2008 costs of the salary adjustments and other economic benefits which are required by the agreements. Copies of the agreements and cost estimates for Fiscal Years 2007 and 2008 are being submitted separately to the Committees on Ways and Means.

Sufficient revenues are estimated to be available to finance these appropriations. I urge your prompt and favorable consideration of this bill.

MAKING APPROPRIATIONS FOR FISCAL YEAR 2007 TO PROVIDE FOR CERTAIN COLLECTIVE BARGAINING AGREEMENTS.

To provide for certain collective bargaining costs, including the cost of salary adjustments and other economic benefits authorized by collective bargaining agreements between the commonwealth and the American Federation of State, County and Municipal Employees (Unit 2), the Service Employees International Union, Local 509 (Units 8 & 10), the Massachusetts Correction Officers Federated Union (Unit 4A), and the Massachusetts Organization of State Engineers and Scientists (Unit 9); between the Berkshire sheriff's department and the International Brotherhood of Correctional Officers, Local R1-297, and the Berkshire County Sheriff's Office Employees' Association; between the Franklin sheriff's department and the International Brotherhood of Teamsters, Local 404 and the Non-Unit Employees Association; between the Essex sheriff's department and the International Brotherhood of Correctional Officers, Local R1-27, the Essex County Correctional Officers Association, and the International Brotherhood of Correctional Officers, Local R1-71; between the Hampden sheriff's department and the International Brotherhood of Correctional Officers, Local 248, the Hampden County Superior Correctional Officers Association and the Non-Uniformed Correctional Association; between the Hampshire sheriff's department and the United Food & Commercial Workers, Local 1459, the Senior Correctional Officers Association, the Non-Uniform Correctional Association, and the Sheriff's Office Treatment Association; between the commonwealth and various unions at the registries of deeds; and between the Norfolk sheriff's office and the County Correctional Officer's Association the sums set forth in section 2 are hereby appropriated from the General Fund, subject to the law regulating the disbursement of public funds and the conditions pertaining to appropriations in chapter 139 of the acts of 2006. The sums appropriated in section 2 shall not revert and shall be available for expenditure through June 30, 2008.

SECTION 2.
EXECUTIVE OFFICE FOR ADMINISTRATION AND FINANCE.
Reserves.
1599-4232 For a reserve to meet the fiscal year 2008 costs of salary adjustments and other economic benefits authorized by the collective bargaining agreement between the commonwealth and the American Federation of State, County and Municipal Employees (Unit 2), and to meet the fiscal year 2008 costs of salary adjustments and other economic benefits necessary to provide equal adjustments and benefits to employees employed in confidential positions which otherwise would be covered by this agreement; provided, that the personnel administrator, with the approval of the secretary of administration and finance, shall determine these adjustments and benefits for the confidential employees in accordance with the collective bargaining agreement then in effect which otherwise would cover these positions; provided further, that the secretary may transfer from the sum appropriated in this item to other items of appropriation and allocations thereof for fiscal year 2008 amounts that are necessary to meet these costs where the amounts otherwise available are insufficient for the purpose, in accordance with a transfer plan which shall be filed in advance with the house and senate committees on ways and means; and provided further, that in order to implement articles 19 and 25 of the agreement, $195,000 shall be available through June 30, 2009 $10,716,559
1599-4233 For a reserve to meet the fiscal year 2007 and 2008 costs of salary adjustments and other economic benefits authorized by the collective bargaining agreement between the commonwealth and the Service Employees International Union, Local 509 (Units 8 & 10), and to meet the fiscal year 2007 and 2008 costs of salary adjustments and other economic benefits necessary to provide equal adjustments and benefits to employees employed in confidential positions which otherwise would be covered by this agreement; provided, that the personnel administrator, with the approval of the secretary of administration and finance, shall determine these adjustments and benefits for the confidential employees in accordance with the collective bargaining agreement then in effect which otherwise would cover these positions; provided further, that the secretary may transfer from the sum appropriated in this item to other items of appropriation and allocations thereof for fiscal year 2008 amounts that are necessary to meet these costs where the amounts otherwise available are insufficient for the purpose, in accordance with a transfer plan which shall be filed in advance with the house and senate committees on ways and means; and provided further, that in order to implement articles 19 and 23A of the agreement, $296,255 shall be available through June 30, 2009 $29,501,423
1599-4234 For a reserve to meet the fiscal year 2007 and 2008 costs of salary adjustments and other economic benefits authorized by the collective bargaining agreement between the commonwealth and the Massachusetts Correction Officers Federated Union (Unit 4A), and to meet the fiscal year 2007 and 2008 costs of salary adjustments and other economic benefits necessary to provide equal adjustments and benefits to employees employed in confidential positions which otherwise would be covered by this agreement; provided, that the personnel administrator, with the approval of the secretary of administration and finance, shall determine these adjustments and benefits for the confidential employees in accordance with the collective bargaining agreement then in effect which otherwise would cover these positions; and provided further, that the secretary may transfer from the sum appropriated in this item to other items of appropriation and allocations thereof for fiscal year 2008 amounts that are necessary to meet these costs where the amounts otherwise available are insufficient for the purpose, in accordance with a transfer plan which shall be filed in advance with the house and senate committees on ways and means $50,234,843
1599-4235 For a reserve to meet the fiscal year 2008 costs of salary adjustments and other economic benefits authorized by the collective bargaining agreement between the commonwealth and the Massachusetts Organization of State Engineers and Scientists (Unit 9), and to meet the fiscal year 2008 costs of salary adjustments and other economic benefits necessary to provide equal adjustments and benefits to employees employed in confidential positions which otherwise would be covered by this agreement; provided, that the personnel administrator, with the approval of the secretary of administration and finance, shall determine these adjustments and benefits for the confidential employees in accordance with the collective bargaining agreement then in effect which otherwise would cover these positions; provided further, that the secretary may transfer from the sum appropriated in this item to other items of appropriation and allocations thereof for fiscal year 2008 amounts that are necessary to meet these costs where the amounts otherwise available are insufficient for the purpose, in accordance with a transfer plan which shall be filed in advance with the house and senate committees on ways and means; and provided further, that in order to implement article 23A of the agreement, $20,000 shall be available through June 30, 2009 $5,646,168
1599-4236 For a reserve to meet the fiscal year 2008 costs of salary adjustments and other economic benefits authorized by the collective bargaining agreement between the Berkshire sheriff's department and the International Brotherhood of Correctional Officers, Local R1-297, and to meet the fiscal year 2008 costs of salary adjustments and other economic benefits necessary to provide equal adjustments and benefits to employees employed in confidential positions which otherwise would be covered by this agreement; provided, that the personnel administrator, with the approval of the secretary of administration and finance, shall determine these adjustments and benefits for the confidential employees in accordance with the collective bargaining agreement then in effect which otherwise would cover these positions; and provided further, that the secretary may transfer from the sum appropriated in this item to other items of appropriation and allocations thereof for fiscal year 2008 amounts that are necessary to meet these costs where the amounts otherwise available are insufficient for the purpose, in accordance with a transfer plan which shall be filed in advance with the house and senate committees on ways and means $214,827

1599-4251 For a reserve to meet the fiscal year 2008 costs of salary adjustments and other economic benefits authorized by the collective bargaining agreement between the Norfolk sheriff's office and the County Correctional Officer's Association, and to meet the fiscal year 2008 costs of salary adjustments and other economic benefits necessary to provide equal adjustments and benefits to employees employed in confidential positions which otherwise would be covered by this agreement; provided, that the personnel administrator, with the approval of the secretary of administration and finance, shall determine these adjustments and benefits for the confidential employees in accordance with the collective bargaining agreement then in effect which otherwise would cover these positions; and provided further, that the secretary may transfer from the sum appropriated in this item to other items of appropriation and allocations thereof for fiscal year 2008 amounts that are necessary to meet these costs where the amounts otherwise available are insufficient for the purpose, in accordance with a transfer plan which shall be filed in advance with the house and senate committees on ways and means $356,720

SECTION 3. Notwithstanding any general or special law to the contrary, if the balance in the General Fund as of June 30, 2007 is not sufficient for the appropriations made by this act, the comptroller shall obtain sufficient funds by not transferring from the General Fund to the Commonwealth Stabilization Fund, in the following order: (1) all or part of the amount required by section 48 of chapter 61 of the acts of 2007; and (2) if necessary, all or part of the amount required by section 5C of chapter 29 of the General Laws.
SECTION 4. This act shall take effect as of June 30, 2007.
