3. What kind of tax benefits can we expect as a result of expanding in MA?

 An existing business that is either relocating in Massachusetts or expanding on their existing footprint may be eligible for tax reduction incentives on both the municipal and state levels. Our Economic Development Incentive Program is a tax incentive program designed to foster job creation and stimulate business growth throughout the Commonwealth. 4.  How and where do I get a business license?

Local Filing:  Under Mass General Laws, Chapter 110, Section 5, a person doing business under a name different than his/her own must file a "dba" (doing business as) at the city or town hall clerk's office where you maintain an office.  The fee for this filing varies from town to town but typically costs $30.00 for four years.  The only case in which you do not have to file a "dba" is when you are doing business as a sole proprietor under your own complete name, such as "John Smith Company."

Your filing of a business certificate does not protect your name as does a corporate filing or a trademark registration.  Often a city or town may accept more than one certificate with an identical business name.  

5.  How do I incorporate my business?


There can be as few as one person to establish a corporation.  You must state the purpose of the corporation.  Typically, taxes and liability considerations determine whether to incorporate.  The filing fees vary depending on what type of Corporation you file.  You do not have to file with your city or town hall if you file with the Secretary of State's office. 6.  Are there any other licenses required for me to start my business?


Be sure to check with the Office of Consumer Affairs, Division of Professional Licensure at 617-727-3074 or their website: http://www.mass.gov/dpl.  The OCBR also has a toll-free number at 1-888-283-3757.

In addition, if the proposed business involves handling of sensitive matters (fresh foods, meats, waste, etc.) they should be directed to their local board of health.

7.  Where can I obtain a license for my cart to sell at a fair or on the street?

Contact the Division of Standards at 617-727-3480 to obtain a Peddlers or Hawkers license.  

 

8. Where do I check if a name of a business has been taken?

Contact the Secretary of State’s Office, Division of Corporations 617-727-9640.  If you have decided on a name for your corporation but are not yet ready to incorporate, you can reserve a name for 30 days for a fee of $30.00.

 

9.  I have a great idea and want to start my own business.  Who do I call and where do I get financing?

Contact their local Massachusetts Small Business Development Center (SBDC).  SBDC’s provide one-on-one management and technical assistance for prospective small businesses throughout the Commonwealth.  In short, they assist people in developing a business plan with the end goal of attaining financing through federal loan programs or more conventional financing.   To find the appropriate regional office visit their website at: www.msbdc.org.

 

10. Do I need a business plan and who can help write a business plan?

You need a business plan if you are looking for financing for your business.  The Small Business Development Center’s will help you put one together, call your local center.  Also the Small Business Administration puts on seminars to help you write a business plan.  Their number is 617-565-5590.   There is also a free counseling service offered by SCORE, through the SBA.  Their number is 617-565-5591

 

11.  Who do I call to file complaint about a business?

The Massachusetts Better Business Bureau can be reached at 508-652-4800.  In addition, consumers may be able to file certain complaints with the state Attorney general's office at 617-727-8400.



12.  Do I need to register my business for tax purposes or where can I obtain a Tax ID number?

13. As a new employer in Massachusetts, who do I contact regarding unemployment insurance contributions?  


Employers of one or more permanent, temporary or part-time workers in Massachusetts must register with the Division of Unemployment Assistance you can contact them at 617-626-5075.
 

 

14.  Do I need an Employer Identification Number for tax purposes?  

If you have more than one employee you'll need an Employer ID (EID) Number from the IRS.  If you currently have an EID for operations in another state, you will not need a new one for your Massachusetts unit.  Call the Internal Revenue Service at 800-829-1040.
