“SECTION___. Section 2 of Chapter 149 of the General Laws, as appearing in the 2004 Official Edition, is hereby amended by inserting at the end thereof the following:-
The attorney general shall make available to the residents of the Commonwealth a 24-hour toll-free hotline which may be used for reporting any suspected violations of section 19C of this chapter, or of 8 U.S.C. 1324a(h)(2), relative to the unlawful employment of unauthorized aliens. Calls to the hotline shall be treated confidentially, and callers shall have the option of reporting any violations anonymously. All complaints, whether received through the hotline, in writing, electronically, or in any other form, shall be recorded and documented by the attorney general and immediately referred to the attorney general of the United States, pursuant to the provisions of 8 U.S.C. 1324a(h)(2). The attorney general shall annually prepare a year-end report detailing all reported violations of section 19C of this chapter and of 8 U.S.C. 1324a(h)(2), the nature of said violations, the date on which each complaint was received, documented and forwarded to the attorney general of the United States, and any enforcement action taken against an employer who knowingly employs illegal aliens in the Commonwealth. Said report shall be submitted to the House and Senate Committees on Ways and Means and to the Joint Committee on Labor and Workforce Development on or before February 1 of each year.

Not later than 10 days after the effective date of this act, the comptroller shall transfer $5,000,000 from the General Fund to the Affordable Housing Trust Fund, established by chapter 121D of the General Laws, provided that such funds shall be administered in accordance with chapter 121D and provided further that not less than $3 million of such funds shall be expended for down payment assistance and technical assistance for the purchase and preservation of multi-family housing developments which are or were subject to final payment, prepayment or termination of a state or federally assisted mortgage or which has received or currently receives assistance and such assistance is expiring under any of the following programs:-
(1) Section 8 of the United States Housing Act of 1937, as amended, 42 U.S.C. Section 1437f; as it applies to new construction, substantial rehabilitation, moderate rehabilitation, property disposition and loan management set-aside programs, or any other program providing project-based rental assistance;
(2) Section 42 of the Internal Revenue Code, as amended, 26 U.S.C.Section 42, the federal Low-Income Housing Tax Credit Program;
(3) Section 101 of the Housing and Urban Development Act of 1965, as amended, 12 U.S.C. Section 1701s as it applies to programs for rent supplement assistance thereunder;
(4)Section 202 of the Housing Act of 1959, as amended, 12 U.S.C. Section 1701q; (5) Section 221(d)(3) of the National Housing Act of 1934, as amended, 12 U.S.C.Section 17151(d)(3) or
(5), the below market interest rate program;
(6) Section 221(d)(4) of the National Housing Act, as amended, 12 U.S.C. Section 17151 (d)(4), to the extent the project’s rents are regulated pursuant to a government agreement;
(7) Section 236 of the National Housing Act, as amended, 12 U.S.C.Section 1715z-l;
(8) Section 515 of the Housing Act of 1949, as amended, 42 U.S.C. Section 1485;
(9) Section 521 of the Housing Act of 1949, as amended, 42 U.S.C. Section 1490a;
(10) The federal Urban Development Action Grant, “UDAG”, as amended, 42 U.S.C. Section 5318, to the extent project’s rents are regulated pursuant to a government agreement;
(11) The federal Housing Development Action Grant, “HODAG”, as amended, 42 U.S.C. Section 1437o, to the extent project’s rents are regulated pursuant to a government agreement;
(12) Chapter 121A of the general laws, to the extent project’s affordability of dwelling units is regulated; or
(13) Section 13A of Chapter 708 of
the Acts of 1966.

MassDevelopment Revenue and Accountability Act
Section 1. Clause 16 of section 3 of chapter 23G of the General Laws, as appearing in the Official 2000 Edition, is hereby amended by adding the following at the end thereof: “; provided, however, the Agency shall be required to remit to the General Fund annually an amount of not less than five hundred thousand Dollars from revenues received by the Agency.”
Section 2.
Clause 23 of section 3 of chapter 23G of the General Laws, as appearing in the
Official 2000 Edition, is hereby amended by adding the following at the end
thereof: “;provided, however, that the Agency, upon the land owned or operated
by the Agency that was previously operated by or on behalf of the federal
government as “Fort Devens,” shall at all times be
required to provide for the maintenance, full use, and enjoyment of
transitional or permanent housing facilities for the homeless, or those at risk
of being homeless, to be operated by Applicants whose application for the use
of buildings, facilities, and/or land at the former Fort Devens
was allowed, granted, and/or approved by the United States Department of
Housing and Urban Development, the United States Department of Defense, or any
other agency of the United States Government, and such housing facilities and
services are to be provided within or on the land, buildings, residential
units, administrative offices, and playground facilities identified in the
applications submitted by such Applicants.
If such land, buildings, residential units, administrative offices, and
playground facilities identified in the applications submitted by such
Applications are not habitable because of environmental contamination, the
Agency shall provide the equivalent land, buildings, residential units,
administrative offices, and playground facilities elsewhere in the property
formerly known as
Section 3. Section 10 of chapter 23G of the General Laws, as appearing in the Official 2000 Edition, is hereby amended by striking the word “biennial” and substituting in place thereof the word “annual” and by adding the following at the end thereof: “; provided, however, that the Agency shall at all times be required to maintain detailed books and records of all legal and other professional fees and expenses incurred by outside counsel or other professionals retained by or on behalf of the Agency, including (i) copies of all invoices for fees and expenses, which invoices shall include detailed entries for all time incurred by such outside counsel or other professionals and (ii) a written disclosure of any personal or professional relationships between said outside counsel or other professionals and any officer, director, or employee of the Agency; such books and records shall be subject to review immediately upon request of the house or senate committees on ways and means.”
Section 4. Section 17 of chapter 23G of the General Laws, as appearing in the Official 2000 Edition, is hereby amended by adding at the end of the second paragraph therein the following: “Prior to the disposition of any state surplus lands or any interest therein acquired by the Agency, the Agency shall file with the house and senate committees on ways and means a written disclosure detailing with specificity any personal or professional relationships between any officer, director, or employee of the Agency and any party involved with said disposition, including any purchaser, outside counsel or other professional involved with the disposition. The Agency shall, within thirty days of any request by the house or senate committees on ways and means, provide such committees with a detailed summary of all legal and other professional fees and expenses incurred by outside counsel or other professionals retained by or on behalf of the Agency in connection with any such disposition.”
Section 5. Section 34 of chapter 23G of the General Laws, as appearing in the Official 2000 Edition, is hereby amended by adding the following at the end thereof: “; Such annual report shall also include (i) a detailed summary of all legal, state and federal lobbying, and other professional fees and expenses incurred by outside counsel or other professionals retained by or on behalf of the Agency and (ii) a written disclosure of any personal or professional relationships between said outside counsel, lobbyists, or other professionals and any officer, director, or employee of the Agency."

Ms. Menard moved that the bill amended by inserting, after Section 104, the

“Section 105. There is hereby established a special legislative commission on the issuance, reissuance, sale and resale of tickets in the Commonwealth. Said commission shall consist of the Chairs of the Joint Legislative Committee on Consumer Protection and Professional Licensure, the Chairs of the Joint Legislative Committee on Community Development and Small Business; one member of the Senate to be appointed by the Senate Minority Leader, and one member of the House to be appointed by the House Minority Leader.
Said commission shall conduct public hearings to examine the issues pertaining to the issuance, reissuance, sale and resale of sports and entertainment tickets in the Commonwealth including but not limited to, the issuance, reissuance, sale and resale of tickets by sports franchises in the Commonwealth, the sale and resale of tickets by independent ticket agencies and brokers in the Commonwealth and the sale and resale of tickets in the Commonwealth and outside of the Commonwealth by individuals, ticket agencies, ticket brokers, sports franchises and entertainment venues through the use of the internet or other electronic means, the sale or resale of tickets in the Commonwealth for sports and entertainment events held outside of the Commonwealth and the sale or resale of tickets outside of the Commonwealth for sports and entertainment events held inside of the Commonwealth. The commission shall also consider the conflict of laws with other states and jurisdictions and the fees, service charges and surcharges associated with the sale and resale of said tickets in the Commonwealth.
Said commission shall file a report of its findings together with any
legislative recommendations to the Clerk of the House of Representatives and
the Clerk of the Senate no later than

“For a program of rental assistance
for low-income families and elderly persons through mobile and project-based
vouchers; provided, that rental assistance shall only be paid under a program
to be known as the Massachusetts rental voucher program; provided further, that
the income of the households shall not exceed 200 per cent of the federal
poverty level; provided further, that the department may award mobile vouchers
to eligible households currently occupying project-based units that shall
expire due to the nonrenewal of project-based rental
assistance contracts; provided further, that the department, as a condition of
continued eligibility for vouchers and voucher payments, may require disclosure
of social security numbers by participants and members of participants’
households in the Massachusetts rental voucher program for use in verification
of income with other agencies, departments and executive offices; provided
further, that any household in which a participant or member of a participant’s
household shall fail to provide a social security number for use in verifying
the household’s income and eligibility shall no longer be eligible for a
voucher or to receive benefits from the voucher program; provided further, that
the vouchers shall be in varying dollar amounts and shall be set by the
department based on considerations, including, but not limited to, family size,
composition, income level and geographic location; provided further, that
notwithstanding any general or special law to the contrary, the monthly dollar
amount of each voucher shall be the department-approved total monthly rent of
the unit less the monthly amount paid for rent by the household; provided
further, that notwithstanding any general or special law to the contrary, the
use of rent surveys shall not be required in determining the amounts of the
mobile vouchers or the project-based units; provided further, that any
household which is proven to have caused intentional damage to its rental unit
in an amount exceeding 2 month’s rent during any 1-year lease period shall be
terminated from the program; provided further, that notwithstanding any general
or special law to the contrary, a mobile voucher whose use is or has been
discontinued shall be re-assigned within 90 days; provided further, that the
department shall pay agencies $32.50 per voucher per month for the costs of
administering the program; provided further, that subsidies shall not be
reduced for the cost of accommodating the cost of the inspections; provided
further, that notwithstanding any general or special law to the contrary, each
household holding a project-based voucher shall pay at least 30 per cent but
not more than 40 per cent of its income as rent, and each household holding a
mobile voucher shall pay at least 30 per cent but not more than 40 per cent of
its income as rent; provided further, that the department shall establish the
amounts of the mobile vouchers and the project-based vouchers, so that the
appropriation in this item is not exceeded by payments for rental assistance
and administration; provided further, that the department shall not enter into
commitments which will cause it to exceed the appropriation set forth in this
item; provided further, that the households holding mobile vouchers shall have
priority for occupancy of the project-based dwelling units in the event of a
vacancy; provided further, that the department may impose certain obligations
for each participant in the Massachusetts rental voucher program through a
12-month contract which shall be executed by the participant and the
department; provided further, that these obligations may include, but need not
be limited to, job training, counseling, household budgeting and education, as
defined in regulations promulgated by the department and to the extent these
programs are available; provided further, that each participant shall be
required to undertake and meet these contractually established obligations as a
condition for continued eligibility in the program; provided further, that for
continued eligibility each participant shall execute this 12-month contract on
or before September 1, 2006 if the participant’s annual eligibility
recertification date occurs between June 30, 2006 and September 1, 2006 and
otherwise on or before the annual eligibility recertification date; provided
further, that any participant who is over the age of 60 years or who is
handicapped may be exempted from any obligations unsuitable under particular
circumstances; provided further, that the department shall submit an annual
report not later than February 1, 2007 to the secretary of administration and
finance and the house and senate committees on ways and means detailing
expenditures, the number of outstanding rental vouchers by income level and the
number and types of units leased that are funded from this item; provided
further, that no funds shall be expended from this item in the AA object class
for the compensation of state employees; provided further, that the department
may assist housing authorities, at their written request, in the immediate
implementation of a homeless prevention program utilizing alternative housing
resources available to them for low-income families and the elderly by
designating participants in the Massachusetts rental voucher program as at risk
of displacement by public action through no fault of their own; provided
further, that participating local housing authorities may take all steps
necessary to enable them to transfer mobile voucher program participants from
the Massachusetts rental voucher program into another housing subsidy program;
Provided further, that not more than $2,600,000 may be expended and provided further
to encourage the renewal of project-based rental assistance contracts by
allowing for rent adjustments and the correction of rent disparities; that the
department of housing and community development shall strive to avoid a
reduction in the value of the Massachusetts rental voucher from its value as of
June 30, 2006...................................... $29,883,345”.
