RADIOLOGICAL EMERGENCY RESPONSE PLAN

Mr. Pacheco moved that the bill be amended by inserting, after Section _____, the following new Section:

“SECTION _____.  The Executive Office of Public Safety shall provide a grant to Plymouth, the town in which the Pilgrim Nuclear Power Plant is located, and to Braintree, Bridgewater, and Taunton, the cities and towns that are required to provide services to the Pilgrim Nuclear Power Plant as “host communities,” as defined under the radiological emergency response plan of the commonwealth approved on January 10, 2003, utilizing if available, but not limited to, federal Department of Homeland Security funds.  The grant shall be sufficient to provide for public safety service equal to the levels of public safety service provided for as of January 10, 2003, and shall be awarded only if Plymouth or the host community meets the following criteria, as determined by the division of local services of the department of revenue:  (1) the community has exhausted all available reserves; (2) the community is taxing to its levy limits; and (3) aggregate local aid reductions since fiscal year 2004 for the community has caused a reduction in the number of public safety employees in the city or town.”

HAZMAT TRACKING AND RECOVERY PILOT PROGRAM

Mr. Timilty moved that the bill be amended, in Section 2, in item 8000-0000, by adding at the end thereof the following: - “provided further, that $500,000 shall be available to acquire through procurement, a pilot program to enhance the public safety of the Commonwealth. Said pilot program shall be established to implement technologies and systems to protect public health and safety in the transportation of hazardous materials; provided, that said pilot program shall establish, implement and administer a uniform registration, permitting, tracking, location and recovery program for persons who transport hazardous material or hazardous waste by motor vehicle on the public highways in interstate or intrastate commerce; provided, that said pilot program assess the feasibility of implementation and effectiveness of the registration; permitting; tracking; location and recovery, integrated with the Executive Office of Public Safety, of hazardous materials in the Commonwealth; provided further, that any vendor engaged contractually by said executive office must have prior experience with recovery infrastructure and automatic and direct integration with law enforcement agencies in the Commonwealth,” and moved to further amend said item by striking the figure “$2,345,873” and inserting in place thereof the following figure: - “$2,845,873”.

HAMPDEN COUNTY WOMEN'S CORRECTIONAL FACILITY

“In accordance with the measures originally authorized in Chapter 12 of the Acts of 1996, not less than $6,000,000 shall be expended, through DCAMM, for the construction of the 56 cell ‘alternate unit’ of the Hampden County Women’s Correctional Facility in the City of Chicopee.”

“8000-_____      For emergency equipment grants to be administered by the executive office of public safety and awarded to cities and towns for the purchase of durable equipment, provided that such grants be awarded on a one-time basis and may be conditioned on a match of funding from grant recipients; provided further that not less than $70,000 shall be provided to the town of Rowley for the purchase of an emergency generator; provided further that $225,000 shall be provided to the town of Wayland for the purchase of an emergency generator; provided further that funds from this item shall be provided to the town of North Attleboro for the purchase of an emergency generator; provided further that the executive office of public safety shall submit a report to the house and senate committees on ways and means detailing the amounts of grants awarded to grant recipients and descriptions of equipment purchased through grant awards…………………………………………………….$1,500,000”

FIREFIGHTING EQUIPMENT GRANT PROGRAM

Messrs. Brewer, Barrios, Knapik, Timilty, Tarr, and Bouniconti moved that the bill amended, in Section 2, by inserting after item 8000-0040 the following item:-

8000-0050 For the firefighting equipment grant program for fire departments of every city, town, fire district and authority of the commonwealth to be administered by the executive office of public safety, provided that grants shall be distributed to municipalities according to a formula giving equal weight to each municipalities population; provided further, that eligible fire safety equipment under this program shall include, but is not limited to, turnout gear, hand-held power lights, communication devices, telephones, personal alert safety systems, so called, air packs, tanks, compressors, thermal imaging devices and computerized personnel accountability systems, but shall exclude firefighter apparatus and vehicles; provided further that grants awarded by said executive office to a municipality under said program shall not be utilized for the purpose of personnel costs unless such costs constitute 50 percent or less of the total grant award; provided further that no grant shall be awarded to the department of fire services; provided further that not later than February 1, 2007, the executive office of public safety shall submit a report to the house and senate committees on ways and means and to the secretary for administration and finance detailing the amount of grants awarded to said grant recipients and descriptions of said grants and each municipality will provide the executive office of public safety with a comprehensive list of the best-practices that have been instituted as a result of these grants ...........................$10,000,000

SEX OFFENDER MANDATORY MINIMUMS

Messrs. Brown, Lees, Hedlund, Knapik, Tisei and Timilty moved that the bill be amended by adding the following new section at the end thereof:-

SECTION ___.  Paragraph (b) of subsection (2) of section 178K of chapter 6 of the General Laws, as most recently amended by section 20 of chapter 77 of the Acts of 2003, is hereby further amended by inserting the in the fourth paragraph after the words “dangerousness posed to the public” the following words:-

 

“, however if the offender is convicted for a crime against a minor the offender shall receive a mandatory minimum of a level three classification”

“SECTION XX  Provided that the first paragraph of section 63 of Chapter 277 of the General Laws, as appearing in the 2004 Official Edition, is hereby amended by inserting after the first sentence the following sentence:- An indictment or complaint for an offense set forth in section thirteen B, thirteen F, twenty-two A, twenty-three, of chapter 265, or four A, four B, of chapter two hundred and seventy-two or for conspiracy to commit any of said offenses, or an accessory thereto, or any one or more of them, may be found or brought at any time after the date of the commission of such offense.
SECTION___: Said section 63 of said chapter 277, as so appearing is hereby further amended in lines 3 and 4 by striking out the words “, twenty-two A, twenty-three,”.
SECTION___: The second paragraph of said section 63 of chapter 277, as so appearing, is hereby amended by striking out, in lines 19 and 20, the words “thirteen B, thirteen F, thirteen H, twenty-two, twenty-two A, twenty-three” and inserting in place thereof the following words:- thirteen H, twenty-two,
