Mr. O’ Day of West Boylston, Quinn of Dartmouth, Guyer of Dalton, Greene of Billerica, Rice of Gardner, DiNatale of Fitchburg, Atkins of Concord, Richardson of Framingham, Timilty of Milton, McCarthy of East Bridgewater, Walsh of Boston, Mr. Eldridge of Acton, and Canessa of New Bedford move that the bill be amended in section 2 in item 0611-5510 by adding the following: “Provided further, the Department of Revenue shall conduct a study to determine the cost analysis for providing payment in lieu of taxes to any county correctional facility whose operating expenses paid by the Commonwealth exceeds 50 percent; provided further, that said study shall be completed by October 1, 2008 and submitted to the House and Senate Committees on Ways and Means; provided further, that said payment in lieu of taxes shall not take effect until legislation has been filed and enacted pursuant to Part 2, Chapter 1, Sec.1, Article II of the ConstitutionProvided further that any county correctional facility whose operating expenses paid by the Commonwealth exceeds 50 percent shall be deemed a state facility for lieu of taxes on state-owned land purposes; and in said section by striking out the figures “$28,300,000” and inserting in place thereof the figures “$33,300,000”
