IN THE YEAR TWO THOUSAND FIVE
An Act AUTHORIZING TELECONFERENCE MEETINGS OF GOVERNMENTAL BODIES IN HAVERHILL, MASSACHUSETTS.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Notwithstanding the provisions of section 23B of chapter 39 of the General Laws or any general or special law to the contrary, the city of Haverhill is hereby authorized to use teleconferencing by any member of its governmental bodies to participate in the deliberation of any action before said governmental body. Any deliberation in which a member participates by way of teleconferencing shall be conducted in accordance with all other requirements of section 23B and 23C of chapter 39 of the General Laws. SECTION 2. The agenda for a meeting in which a member will be participating by way of teleconferencing shall include the exact location of the member during any such meeting, and, said location shall be open and accessible to the public. A quorum of the members of the governmental body shall be present within the city of Haverhill during any such teleconferenced meeting. SECTION 3. For the purpose of this act the word “teleconference” shall mean a meeting of a governmental body, the members of which are in different locations connected by electronic means, through audio or video or both.
