An Act authorizing the sale of a certain parcel of land in the city of Waltham to said city. |
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Notwithstanding the provisions of sections 40F-40J of chapter 7 of the General Laws or any other general or special law to the contrary, within thirty days after the effective date of this act, the commissioner of capital asset management and maintenance is hereby authorized and directed to convey by deed to the city of Waltham, for one dollar, the property located in said Waltham identified as Parcel “B” on a plan entitled “Plan of Land in Waltham & Lexington, Massachusetts surveyed for City of Waltham” prepared by Roberge Associates Land Surveying, 21 Mohawk Trail #283, Greenfield, MA 01301, and dated June 15, 2006.
Said parcel contains approximately 281,149 square feet and is known as the Waltham portion of Lot 1 of the former Middlesex County Hospital and is bounded and described as follows:
Beginning at a point at the northwesterly corner of the remaining public way, Bow Street, thence running
S 36° 47’ 14” W a distance of one hundred sixteen and forty-one hundredths feet
(116.41’)
Thence turning and running
N 56° 57’ 36” W a distance of one hundred fifty and ninety-nine hundredths feet
(150.99’), to a point, thence turning and running
N 60° 13’ 36” W a distance of two hundred one and sixty-seven hundredths feet
(201.67’) to a drill hole in a granite bound; thence
turning and running
N 25° 02’ 34” E a distance of four hundred fifty-five and forty-eight hundredths
feet (455.48’) to a rebar ; thence turning and running
S 82° 54’ 56” E a distance of one hundred seventy and twenty hundredths feet
(170.20’) to a point on the corporate boundary line between the City of
Waltham and the Town of Lexington; thence turning and running
S 66° 17’ 35” E a distance of one thousand four hundred ninety-three and seventy-
eight hundredths feet (1493.78’) along the said corporate boundary line to a rebar, thence turning and

(242.12’) to the point of beginning; the last six courses being along the northerly and westerly side line of Bow Street, discontinued by City Council Order No. 29872, approved December 23, 2003
Said parcel shall be conveyed subject to a restriction limiting the use of the parcel to recreation purposes, conservation purposes and flood control and relief measures, including, but not limited to, the placement of drainage lines.
If the property ceases to be used at any time for the purposes described herein, or is used for any purpose other than the purposes stated herein, the property, upon notice by the commissioner of capital asset management and maintenance, shall revert to the care and control of the commonwealth and any further disposition of the property shall be subject to sections 40E to 40J, inclusive, of chapter 7 of the General Laws, and shall require the prior approval of the general court.
SECTION 2. Said conveyance shall be effected upon the tender to the commissioner of a check from the city of Waltham for the full price referenced above.
SECTION 3. This act shall take effect upon its passage.
