An Act further regulating the placement of certain child care facilities. .

    Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1.  Section 3 of chapter 40A of the General Laws, as appearing in the 2002 Official Edition, is hereby amended by inserting after the word “requirements”, in line 56, the following words:---; and provided, further that a city or town may prohibit by zoning ordinance or bylaw or may require a special permit for a child care facility in a residential zone if another child care facility located within a residential zone is situated within a one mile radius thereof.
