In the Year Two Thousand and Seven.

 An Act relative to out of state collection agencies.

 

    Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:


 

   Section 24 of chapter 93 of the General Laws, as appearing in the 2004 Official Edition, is hereby amended by adding the following paragraph:—
   The commissioner of banks shall regulate that nothing in this section, shall be construed to prohibit a person, firm, corporation or association regulated as a collection agency in another state or residing therein from communicating with a debtor in the commonwealth under the following conditions:—
   (a) Agency must be licensed and bonded in home state;
   (b) Collection to be done by interstate means such as telephone, fax or mail;
   (c) Collections are on behalf of creditors outside the commonwealth;
   (d) Agency registers with the commissioner and furnishes proof of licensing and bonding.
