 An Act to eliminate surcharges on purchases of gift certificates.

 

    Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:


 

  SECTION 1. Section 5D of chapter 200A of the General Laws, as appearing in the 2004 Official Edition, is hereby amended by adding the following sentence:-

 

   It shall be unlawful to charge a surcharge, fee or any amount other than the face value of the gift certificate for a gift certificate.

 

   SECTION 2. Section 75C of chapter 266 of the General Laws, as so appearing, is hereby amended by inserting, in line 3 after the word “redeemed” the following words

“or adds a surcharge, fee or an amount other than the face value of the gift certificate”.
