An Act relative to major repair projects under school building assistance. |
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Chapter 208 of the Acts of 2004 is hereby amended by inserting after section 45 the following section:–
SECTION 45A.The commissioner of education shall also include on the list submitted pursuant to section 45 all approved major renovation projects that were approved, but not funded, by the board of education in accordance with section 6 of chapter 70B of the General Laws between December 29, 1987 and August 31, 1999. The list shall identify for each project: (i) type of major repair; (ii) total construction costs; (iii) amount of the initial reimbursement payment pursuant to chapter 70B of the General Laws in effect prior to the effective date of this act, section 329 of chapter 159 of the acts of 2000 as in effect prior to the effective date of this act, and section 668 of chapter 26 of the acts of 2003 as in effect prior to the effective date of this act; (iv) year of application; (v) year of approval, if approved; (vi) rank order on the waiting list; and (vii) other information as appropriate upon the request of the Massachusetts School Building Authority. Projects included on the list submitted pursuant to this section shall not be counted toward the limit found in section 7 of chapter 70B of the General Laws on aggregate estimated amount of total facilities grants approved.
SECTION 2. Section 47 of Chapter 208 of the Acts of 2004 is hereby further amended by inserting after the fourth paragraph the following paragraph:–
For projects on the list submitted pursuant to section 45A with respect to which indebtedness shall have been incurred prior to July 1, 2004, grants shall be restricted to one partial payment which will reflect the amount of the initial reimbursement payment pursuant to chapter 70B of the General Laws in effect prior to the effective date of this act, section 329 of chapter 159 of the acts of 2000 as in effect prior to the effective date of this act, and section 668 of chapter 26 of the acts of 2003 as in effect prior to the effective date of this act.
SECTION 3. The total number of facility grants to be approved pursuant to Section 45A shall be limited to 489 projects, with an aggregated limit of $22,000,000.
