An Act to strengthen environmental enforcement.

    Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

Section 16 of chapter 21A of the General Laws, as appearing in the 2002 Official Edition, is hereby amended by striking out the full paragraph beginning at line 8 through line 46, and inserting in place thereof the following paragraph:—
The department may assess a civil administrative penalty on a person who fails to comply with any provision of any regulation, order, license or approval issued or adopted by the department, or of any law which the department has the authority or responsibility to enforce. Any such penalty shall be an alternative to any other civil penalty that may be prescribed by law
