An Act relative to the reorganization of the Department of Fisheries, Wildlife and Environmental Law Enforcement.

    Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. Section 7 of chapter 21 of the General Laws, as appearing in the 2002 Official Edition, is hereby amended by inserting in line 4 after the words “control of” the following words:— the commissioner.

SECTION 2. Said Section 7 of chapter 21 of the General Laws, as appearing in the 2002 Official Edition, is hereby amended by striking out in lines 4 and 5 the following words:— “the fisheries and wildlife board, hereinafter called the board, which” and inserting in place thereof the following words:— The fisheries and wildlife board, hereinafter called the board,.

SECTION 3. Section 7E of chapter 21 of the General Laws, as appearing in the 2002 Official Edition, is hereby amended by striking out in lines 5 and 6 the following words:— “, and shall make the appointments required to be made by them in the manner herein provided”.

SECTION 4. Said Section 7E of chapter 21 of the General Laws, as appearing in the 2002 Official Edition, is hereby amended by striking out in lines 7 through 11 the following words:— “, except in the case of the appointment or removal of the director of the division or the approval of the appointment or removal of the superintendent of the bureau of wildlife research and management as hereinafter provided for”.

SECTION 5. Section 7E of chapter 21 of the General Laws, as appearing in the 2002Official Edition, is hereby amended by striking out lines 12 through 18.

SECTION 6. Said Section 7F of chapter 21 of the General Laws, as appearing in the 2002 Official Edition, is hereby amended by striking in lines 2 and 3 the following words:— “board of the division of fisheries and wildlife” and inserting in place thereof the following word:— commissioner.

SECTION 7. Said Section 7F of chapter 21 of the General Laws, as appearing in the 2002 Official Edition, is hereby amended in lines 4 through 9 by striking out the second sentence and inserting in place thereof the following sentence:— The commissioner, with the advice of the fisheries and wildlife board, may appoint, without regard for the provisions of chapter thirty-one, an assistant director for non-game and endangered species and may assign to such assistant director appropriate duties related to the area of non-game and endangered species protection and management.

SECTION 8. Said Section 7F of chapter 21 of the General Laws, as appearing in the 2002 Official Edition, is hereby amended by striking out, in line 11, the word “board” and inserting in place thereof the following words:— the commissioner.

SECTION 9. Said Section 7F of chapter 21 of the General Laws, as appearing in the 2002 Official Edition, is hereby amended by striking out, in line 12, the word “he” and inserting in place thereof the following words:— the commissioner.

SECTION 10. Said Section 7F of chapter 21 of the General Laws, as appearing in the 2002 Official Edition, is hereby amended by striking out, in line 13, the words “its operations” and inserting in place thereof the following words:— the operations of the division,.

SECTION 11. Section 7G of chapter 21 of the General Laws, as appearing in the 2002 Official Edition, is hereby amended by adding in line 8 after the words “division to” the following words:— the commissioner,.

SECTION 12. Said Section 7G of chapter 21 of the General Laws, as appearing in the 2002 Official Edition, is hereby amended by striking out in line 1, the word “board” and inserting in place thereof the following words:— the commissioner.

SECTION 13. Said Section 7G of chapter 21 of the General Laws, as appearing in the 2002 Official Edition, is hereby amended by striking out in line 4, the word “board” and inserting in place thereof the following words:— the commissioner.

SECTION 14. Section 7H of chapter 21 of the General Laws, as appearing in the 2002 Official Edition, is hereby amended by striking out in line 4 the words: “the director, with the approval of the board, and may be removed by him with like approval” and inserting in place thereof the following words:— the commissioner, with the advice of the board, and may be removed by him with like advice.

SECTION 15. Said Section 7H of chapter 21 of the General Laws, as appearing in the 2002 Official Edition, is hereby amended by striking out in line 8 the word: “director” and inserting in place thereof the following word:— commissioner.

SECTION 16. Said Section 7H of chapter 21 of the General Laws, as appearing in the 2002 Official Edition, is hereby amended by striking out in line 14 the word: “director” and inserting in place thereof the following word:— commissioner.

SECTION 17. Said Section 7H of chapter 21 of the General Laws, as appearing in the 2002 Official Edition, is hereby amended by striking out in line 20 the words: “director with the approval of the board” and inserting in place thereof the following words:— the commissioner with the advice of the board.

SECTION 18. Section 2A of chapter 131 of the General Laws, as appearing in the 2002 Official Edition, is hereby amended by striking out in line 15 the following words:— “and consent”.

SECTION 19. Said Section 2A of chapter 131 of the General Laws, as appearing in the 2002 Official Edition, is hereby amended by inserting after the word “board”, in line 15, the following words:— and the consent of the commissioner.

SECTION 20. Section 4 of chapter 131 of the General Laws, as appearing in the 2002 Official Edition, is hereby amended by striking out in line 172 the following word: “approval” and inserting in place thereof the following word:— advice.

SECTION 21. Said Section 4 of chapter 131 of the General Laws, as appearing in the 2002 Official Edition, is hereby amended by inserting after the word “board”, in line 173, the following words:— and the consent of the commissioner.

SECTION 22. Section 5 of chapter 131 of the General Laws, as appearing in the 2002 Official Edition, is hereby amended by striking out in line 16 the following word: “approval” and inserting in place thereof the following word:— advice.

SECTION 23. Said Section 5 of chapter 131 of the General Laws, as appearing in the 2002 Official Edition, is hereby amended by striking out in line 21 the following word: “approval” and inserting in place thereof the following word:— advice.

SECTION 24. Said Section 5 of chapter 131 of the General Laws, as appearing in the 2002 Official Edition, is hereby amended by inserting after the word “board”, in line 22, the following words:— and the consent of the commissioner,.

SECTION 25. Section 6 of chapter 131 of the General Laws, as appearing in the 2002 Official Edition, is hereby amended by striking out in line 1 the following word: “approval” and inserting in place thereof the following word:— advice.

SECTION 26. Said Section 6 of chapter 131 of the General Laws, as appearing in the 2002 Official Edition, is hereby amended by inserting after the word “board”, in line 12, the following words:— and the consent of the commissioner,.

SECTION 31. Section 30 of chapter 131 of the General Laws, as appearing in the 2002 Official Edition, is hereby amended by striking out in line 7 the following word: “approval” and inserting in place thereof the following word:— advice.
