In the Year Two Thousand and Seven.

 An Act establishing Brownfield cleanup standards.

 

    Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:


 

Chapter 21E of the General Laws, as defined in the 2004 Official Edition, is hereby amended by adding the end thereof the following section:-

 

Section 20 Brownfield Cleanup Practices.

               

                (1) The Brownfield property shall implement a “use based approach” to cleanup   standards, whereas the intended use of the property will dictate the cleanup       approach.

               

                (2) Redevelopment parties shall be allowed to clean-up contaminated properties                   within their jurisdictions and shall be free from liability if such clean-ups are    conducted in a manner that suffices standards approved by the waste site cleanup              professional licensed by the Commonwealth pursuant to section 19 to 19J,    inclusive of Chapter 21A.
