Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
Chapter 175 of the General Laws is hereby amended by inserting after section 149L the following section :-
Section 149M. To assure faithful performance a travel agent prior to engaging in the business of a travel agent shall file with the commissioner a surety bond in the amount of $250,000 which shall have been issued by an authorized surety company and approved the commissioner as to issuer, form and contents. The bond shall not be cancelled or subject to cancellation unless 30 days advance notice in writing is filed with the commissioner. Notwithstanding the foregoing, if a bond is canceled for any reason and a new bond in the required amount is not received by the commissioner on or before the effective date of the cancellation the travel agent shall cease to engage in the business of travel agent. If a travel agent ceases to do business in the commonwealth and furnishes to the commissioner satisfactory proof that he ha discharged all obligations to customers the surety bond shall be released.
For the purposes of this section a travel agent shall be any person, firm, corporation, partnership or association, other than a common carrier or employee of a common carrier who is: (a) an officially appointed agent of a common carrier or a member of a cruise line association and who operates exclusively as an agent for cruise lines in the sale of cruise travel products or services; or (b) a legal agent for a provider of travel services who sells or offers for sale, travel, transportation or vacation arrangements.
