Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Section 113 B of Chapter 175 of the Massachusetts General Laws, as appearing in the 2004 official edition, is hereby amended by placing thereof the following.-
There shall be no surcharge incurred by an insured motorist if they have had only one incident subject to a surcharge, defined herein, within any four year period.
