In the Year Two Thousand and Seven.

 An Act  relative to mastectomies.

 

    Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:


 

SECTION 1. Chapter 32A of the General Laws is hereby amended by inserting after section 17H the following section:-

 

Section 17I.  The commission shall provide to any active or retired female employee of the commonwealth who is insured under the group insurance coverage for the cost of a mastectomy and coverage for a minimum of 48 hours in-patient care.

 

SECTION  2.  Chapter 175 of the Genenral Laws is hereby amended by inserting after section 47X the following section:-

 

Section 47Y.  Any policy of accident or sickness insurance delivered, issued or renewed in the commonwealth pursuant to this chapter shall provide coverage for the cost of a mastectomy and coverage for a minimum of 48 hours in-patient care.

 

SECTION 3.  Chapter 176A is hereby amended by inserting after section 8Y the following section:-

 

Section 8Z.  Any contract between a female subscriber and the corporation under an individual or group hospital service plan delivered or issued or renewed within the commonwealth shall provide for coverage of the cost of a mastectomy and coverage for a minimum of 48 hours in-patient care.

 

SECTION 4.  Chapter 176G of the General Laws is hereby amended by inserting in section 4Q the following section:-

 

Section 4R.  Any individual female or group maintenance contract that issued renewal or delivered within or without the commonwealth shall provide coverage for the cost of a mastectomy and coverage for a minimum of 48 hours in-patient care.

 

SECTION 5.  Chapter 176I of the General laws is hereby amended by inserting after Section 3 the following section:-

 

Section 3A.  Health benefit policies or plans for covered females shall provide coverage for the costs of a mastectomy and coverage for a minimum of 48 hours in-patient care.

 

SECTION  6.  Chapter 176A of the General Laws is hereby amended by inserting after section 2 the following section:-

 

Section 3.  Any non group health plan offered, sold, issued, delivered, made effective or renewed by any carrier shall provide coverage for the costs of a mastectomy and coverage for a minimum of 48 hours in-patient care for females
