An Act further regulating the use of personal information by insurance companies. |
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Chapter 175 of the General Laws is hereby amended by adding
the following new section:—
Section 2C. Notwithstanding the provisions of any law or regulation to the contrary, no insurance company shall disclose any nonpublic personal information contrary to the provisions of Title V of the federal Financial Services Modernization Act of 1999 (public law 106-102), known as the Gramm-Leach-Bliley Act. The commissioner of insurance may adopt rules and regulations to carry out this section in accordance with the requirements of chapter thirty A of the General Laws. Such rules and regulations shall be consistent with and not more restrictive than standards contained in regulations promulgated under Title V of the Gramm-Leach-Bliley Act by federal regulatory agencies governing financial institutions doing business in the commonwealth. Nothing in this section shall be construed to create a private cause of action.
