An Act directing MassHealth to draft regulations for medical day care providers.

    Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. The office of Medicaid (MassHealth) is hereby authorized and directed to draft regulations for a new provider category titled “medical day care.” The department shall provide a draft of proposed regulations to the joint committees of public health and health care financing, not less than 90 days before adopting the regulations and no later than January 1, 2008.

SECTION 2. The office of Medicaid (MassHealth) is also authorized and directed to seek a federal waiver for the creation of a medical day care provider category.
