In the Year Two Thousand and Seven.

 An Act relative to academic freedom in state colleges.

 

    Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:


 

SECTION 1.  Section 14 of chapter 73 of the General Laws, as appearing in the 1996 Official Edition, is hereby amended by adding the following paragraph:—
The trustees are hereby prohibited from accepting any gifts or bequests from any source that places conditions or restrictions on the use of such gifts or bequests in such a way as to interfere with or otherwise limit the academic freedom of a state college. Nothing contained in this paragraph shall be construed in such a way as to prohibit a donor from earmarking a gift or bequest for a particular purpose or use including, but not limited to, research, scholarships, construction or development.

SECTION 2. Section 31 of chapter 74 of the General Laws, as so appearing, is hereby amended by adding the following paragraph:—
Said schools are hereby prohibited from accepting any gift from any source that places conditions or restrictions on the use of such gifts in such a way as to interfere with or otherwise limit the academic freedom of the school. Nothing contained in this paragraph shall be construed in such a way as to prohibit a donor from earmarking a gift for a particular purpose or use including, but not limited to, research, scholarships, construction or development.

SECTION 3. Section 42L of chapter 74, as so appearing, is hereby amended by adding the following paragraph:—
The trustees are hereby prohibited from accepting any gifts or bequests from any source that places conditions or restrictions on the use of such gifts or bequests in such a way as to interfere with or otherwise limit the academic freedom of the college or the institute. Nothing contained in this paragraph shall be construed in such a way as to prohibit a donor from earmarking a gift or bequest for a particular purpose or use including, but not limited to, research, scholarships, construction or development.

SECTION 4. Section 11 of chapter 75 of the General Laws, as so appearing, is hereby amended by adding the following paragraph:—
Said trustees are hereby prohibited from accepting any gifts or bequests from any source that places conditions or restrictions on the use of such gift or bequest in such a way as to interfere with or otherwise restrict the academic freedom of the university. Nothing contained in this paragraph shall be construed in such a way as to prohibit a donor from earmarking a gift or bequest for a particular purpose or use including, but not limited to, research, scholarships, construction or development.
