SECTION 1. Section 62 of chapter 3 of the General Laws, as appearing in the 2004 Official Edition, is hereby amended by striking out, in lines 4 and 5, the words "director of department of housing and development hereinafter referred to as director" and inserting in place thereof the following words:- secretary of the executive office of housing and community development hereinafter referred to as secretary.

SECTION 32. Section 1 of chapter 23B of the General Laws, as so appearing, is hereby amended by striking out said section in its entirety and inserting in place thereof the following:-

Section 1. There shall be within the governor’s cabinet, the executive office of housing and community development, hereinafter called the office, which shall be under the supervision and control of a secretary of the executive office of housing and community development hereinafter called the secretary. The secretary shall be appointed by the governor for a term coterminous with that of the governor. The secretary shall devote his or her full time during business hours to the duties of his or her office. In case of a vacancy in the office of secretary, or in the secretary's absence or disability, the governor shall designate the undersecretary of the office, appointed pursuant of section 3 of chapter 6A, to serve as secretary until the vacancy is filled, or until the absence or disability ceases, and the undersecretary shall have all the powers and duties of the secretary.

The position of secretary of the executive office of housing and community development shall not be subject to the provisions of section 9A of chapter 30 or chapter 31.

SECTION 33. Subsection (a) of section 2 of said chapter 23B, as so appearing, is hereby amended by striking out said subsection in its entirety and inserting in place thereof the following:-

Section 2. (a) There shall be in the office such departments as the secretary may establish including but not limited to: a department of housing; a department of community development; a department of fair housing; a department of housing production and preservation; a department of smart growth; and a department of legislative and community services.

Each department shall be under the charge of a director subject to the direction, control and supervision of the secretary and the undersecretary. Each director shall be a person of skill and experience in the field of his or her appointment and shall be appointed and may be removed by the secretary, with the approval of the governor, and shall serve until so removed. The position of director shall not be subject to the provisions of chapter thirty-one or section nine A of chapter thirty. Each director shall devote his or her full time during business hours to the duties of his office.

SECTION 34. Subsection (b) of said section 2 of said chapter 23B, as so appearing, is hereby amended by striking out, in lines 11 and 17, the word "department" and inserting in place thereof, in each instance, the word:- office

There shall be within the office, a bureau of housing for people with disabilities, in the department of municipal and community services. The bureau shall consist of an associate director, and other such persons as shall be necessary to conduct the work of the department. The associate director shall be selected by the secretary after consultation with representative consumer groups, with preference given to a qualified person with a disability, or to an individual who has expertise in the area of the housing needs of persons with disabilities.

The functions of the bureau shall include but not be limited to the following activities: to coordinate within the office the several program elements relative to housing and services for persons with disabilities of low income; to assist local housing authorities in planning, developing and implementing appropriate housing, management and service programs for persons with disabilities of low income; to issue guidelines and directives and to promulgate rules and regulations relative to adequately housing the handicapped; to promulgate regulations and guidelines relative to contracts entered into for the provisions of services to residents of housing for persons with disabilities, including the management and maintenance of the premises; to approve such contracts; to serve as a focus in developing local and statewide planning to assist handicapped persons obtain the housing and services that will increase their ability to live independently; to seek, accept and otherwise take full advantage of all federal and state aid available to the office to assist in developing housing and related services for persons with disabilities; to assist other agencies to take full advantage of all federal, state and local assistance for housing, rehabilitation, and the provision of services to assist persons with disabilities to live with greater independence; and to work in close cooperation with consumers, including representatives from the various organizations of physically disabled, deaf or blind, and advocates for persons with mental retardation, emotional deficiencies, and other mental disabilities and for other socially disadvantaged and disabled persons, and also all federal, state and local organizations and agencies concerned with developing rational planning and effective implementation of housing and related services for persons with disabilities of low income and to increase their independence, productivity and self-satisfaction.

SECTION 211. Section 1 of chapter 708 of the acts of 1966, is hereby amended by striking out the definition of “Low income persons or families”, and inserting in place thereof the following definition:-

“Low income persons or families”, shall mean those persons and families whose annual income is equal to or less that the maximum amount which would make them eligible for units owned or leased by the housing authority in the city or town in which the project or the residence for which the mortgage loan is sought is located or, in the event that there is no housing authority, that amount which is established as the maximum for eligibility for low-rent units by the executive office of housing and community development

SECTION 212. The first paragraph of section 3 of chapter 708 of the acts of 1966, is hereby amended by striking out the first sentence, as amended by section 502 of chapter 151 the acts of 1996 and by section 43 of chapter 204 of the acts of 1996, and inserting in place thereof the following sentence:- There is hereby created and placed in the executive office of housing and community development a body politic and corporate to be known as the Massachusetts Housing Finance Agency, which shall not be subject to the supervision or control of any executive office, department, commission, board, bureau or agency except to the extent and in the manner provided by law.

SECTION 213. The second paragraph of said section 3 of chapter 708 of the acts of 1966, is hereby further amended by striking out in the first sentence, as amended by section 21 of chapter 761 of the acts of 1968, by section 32 of chapter 163 of the acts of 1975, by section 503 of chapter 151 the acts of 1996 and by section 44 of chapter 204 the acts of 1996, the words "director of housing and community development” and inserting in place thereof the following words:- secretary of the executive office of housing and community development

SECTION 214. Section 1 of chapter 846 of the acts of 1974, is hereby amended by striking out the definition of “Low income persons or families”, and inserting in place thereof the following definition:-

SECTION 215. The first sentence of the first paragraph of section 3 of chapter 846 of the acts of 1974 is hereby amended by striking out the first sentence, as amended by section 504 of chapter 151 of the acts of 1996 and by section 44 of chapter 204 of the acts of 1996, and inserting in place thereof the following sentence:- There is hereby created in the executive office of housing and community development a body politic and corporate to be known as the Massachusetts Home Mortgage Finance Agency, which shall not be subject to the supervision or control of the executive office of housing and community development or of any executive office, department, commission, board, bureau or agency of the commonwealth except to the extent and in the manner provided by law.

SECTION 216. Clause (w1/2) of section 4 of said chapter 846 of the acts of 1974, as amended by section 11 of chapter 789 of the acts of 1981, is hereby amended by striking out the words "secretary of communities and development", and inserting in place thereof the following words:- secretary of the executive office of housing and community development.

SECTION 217. The third sentence of the tenth paragraph of said section 4 of said chapter 846 of the acts of 1974 is hereby further amended by striking out the words "department of community affairs", and inserting in place thereof the words:- executive office of housing and community development.

SECTION 218. The first sentence of the fourteenth paragraph of said section 4 of said chapter 846 of the acts of 1974, as amended by section 7 of chapter 561 of the acts of 1977, is hereby amended by striking out the words "secretary of communities and development", and inserting in place thereof the words:- secretary of the executive office of housing and community development.

SECTION 219. Section 4 of chapter 270 of the acts of 1977 is hereby amended by striking out the words "secretary of the executive office communities and development", and inserting in place thereof the following words:- secretary of the executive office of housing and community development.

SECTION 220. Said section 4 of said chapter 270 of the acts of 1977 is hereby further amended by striking out the words "department of community affairs", and inserting in place thereof the following words:- executive office of housing and community development.

SECTION 221. Section 4 of chapter 502 of the acts of 1977 is hereby amended by striking out the words "secretary of the executive office communities and development", and inserting in place thereof the following words:- secretary of the executive office of housing and community development.

SECTION 222. Said section 4 of said chapter 502 of the acts of 1977 is hereby further amended by striking out the words "department of community affairs", and inserting in place thereof the following words:- executive office of housing and community development.

SECTION 223. Section 4 of chapter 327 of the acts of 1979 is hereby amended by striking out the words "secretary of the executive office communities and development", and inserting in place thereof, wherever they appear, the following words:- secretary of the executive office of housing and community development.

SECTION 224. Said section 4 of chapter 327 of the acts of 1979 is hereby further amended by striking out the words "department of community affairs", and inserting in place thereof the following words:- executive office of housing and community development.

SECTION 225. Section 1 of chapter 487 of the acts of 1980, as amended by section 1 of chapter 784 of the acts of 1981, is hereby amended by striking out the words "secretary of communities and development", in the first sentence, and inserting in place thereof the following words:- secretary of the executive office of housing and community development

SECTION 226. Section 1 of chapter 15 of the acts of 1984 is hereby amended by striking out the words "department of community affairs", and inserting in place thereof the following words:- executive office of housing and community development.

SECTION 227. The second paragraph of section 35 of chapter 405 of the acts of 1985, as amended by section 36 of chapter 102 of the acts of 1990, is hereby amended by striking out the first four sentences of subparagraph (a) and inserting in place thereof the following:-There is hereby created a body politic and corporate to be known as the Massachusetts housing partnership fund board, hereinafter referred to as MHPFB. The MHPFB is hereby constituted a public instrumentality and the exercise by MHPFB of the powers conferred by this act shall be deemed to be the performance of an essential governmental function. The MHPFB is hereby placed in the executive office of housing and community development and shall not be subject to the supervision or control of any executive office, department, commission, board, bureau or agency of the commonwealth except to the extent and in the manner provided by law. The MHPFB shall be governed and its corporate powers exercised by a board of directors, hereinafter referred to as the board of directors.

SECTION 228. Section 12 of chapter 637 of the acts of 1985, as amended by section 63 of chapter 730 of the acts of 1989, is hereby amended by striking out, in line 2, the words "executive office of communities and development", and inserting in place thereof the following words:- executive office of housing and community development.

SECTION 229. Section 2 of chapter 2 of the chapter 405 of the acts of 1987 is hereby amended by striking out the words "secretary of communities and development", and inserting in place thereof the following words:- secretary of the executive office of housing and community development.

SECTION 230. Chapter 181 of the acts of 1988 is hereby amended by striking out the words "department of community affairs", and inserting in place thereof the following words:- secretary of the executive office of housing and community development.

SECTION 231. Clause (1) of section 2 of chapter 716 of the acts of 1989 is hereby amended by striking out the words "communities and development", and inserting in place thereof the following words: -the secretary of the executive office of housing and community development.

SECTION 232. Clause (k) of chapter 133 of the acts of 1990 is hereby amended by striking out the words "executive office of communities and development", and inserting in place thereof the following words:- executive office of housing and community development.

SECTION 233. Said chapter 133 of the acts of 1990 is hereby further amended by striking out the words "department of community affairs", wherever they appear, and inserting in place thereof the following words:- executive office of housing and community development.

SECTION 234. Section 1 of chapter 205 of the acts of 1992 is hereby amended by striking out the words "executive office of communities and development", and inserting in place thereof the following words:- executive office of housing and community development.

SECTION 235. Said chapter 205 of the acts of 1992 is hereby further amended by striking out the words "department of community affairs", wherever they appear, and inserting in place thereof the following words:- executive office of housing and community development.

SECTION 236. Section 1 of chapter 93 of the acts of 1995 is hereby amended by striking out the words "`Secretary', the secretary of communities and development.", and inserting in place thereof the following words: - “Secretary, the secretary of the executive office of housing and community development.

SECTION 237. Paragraph 2 of section 3 of said chapter 93 of the acts of 1995 is hereby further amended by striking out the words "executive office of communities and development", and inserting in place thereof the following words:- executive office of housing and community development

SECTION 238. Paragraph (l) of subsection (p) of section 11 of chapter 294 of the acts of 1996, as amended by section 42 of chapter 235 of the acts of 2000, is hereby amended by striking the words “department of housing and community development and inserting in place thereof the following words:- executive office of housing and community development

SECTION 239. Section 15 of chapter 301 of the acts of 1998 is amended by striking out the words “and the departments of housing and community development,” and inserting in place thereof the following words:- , the executive office of housing and community development and the departments of

SECTION 240. Section 10 of chapter 16 of the acts of 1999 is amended by striking out the words “department of housing and community development,” and inserting in place thereof the following words:- executive office of housing and community development

SECTION 241. Section 223 of chapter 127 of the acts of 1999 is hereby amended by striking out the words "department of housing and community development", and inserting in place thereof the following words:- executive office of housing and community development.

SECTION 242. Section 308 of said chapter 127 is hereby amended by striking out the words "department of housing and community development", and inserting in place thereof the following words: - executive office of housing and community development.

SECTION 243. Said section 308 of said chapter 127 is hereby further amended by striking out the word "department" wherever it appears, and inserting in place thereof, the following word:- office.

SECTION 244. Section 413 of chapter 159 of the acts of 2000, is hereby amended by striking out the words “department of housing and community development” and inserting in place thereof the following words:- executive office of housing and community development

SECTION 245. Section 130 of chapter 46 of the acts of 2003, is hereby amended by striking out the words “the commissioner of the department of housing and community development or designee” and inserting in place thereof the following words:- secretary of the executive office of housing and community development or designee

SECTION 246. Chapter 105 of the acts of 2003 is hereby amended by striking out the words “department of housing and community development” and inserting in place thereof the following words:- executive office of housing and community development

SECTION 247. Subsection (b) of chapter 141 of the acts of 2003, is hereby amended by striking out the words “the director of the department of housing and community development” and inserting in place thereof the following words:- secretary of the executive office of housing and community development

SECTION 248. Section 8 of chapter 53 of the acts of 2005, is hereby amended by striking out the words “department of housing and community development” and inserting in place thereof the following words:- executive office of housing and community development

SECTION 249. Said section 8 of said chapter 53 of the acts of 2005, is hereby amended by striking out the word “department” and inserting in place thereof the following word:- office

SECTION 250. Chapter 52 of the acts of 2006 is hereby amended by striking out the words “department of housing and community development, in this act called the department” and inserting in place thereof the following words:- executive office of housing and community development, in this act called the office

SECTION 251. Section 1 of chapter 101 of the acts of 2006 is hereby amended by striking the definition of “Department” and inserting in place thereof the following definition:- Office, the executive office of housing and community development.

SECTION 252. Section 2A of said chapter 101 of the acts of 2006 is hereby amended by striking the definition of “Secretary” and inserting in place thereof the following definition:- Secretary, the secretary of the executive office of housing and community development.

SECTION 253. Section 1 of chapter 334 of the acts of 2006 is hereby amended by striking out the words "department of community and development", wherever they appear, and inserting in place thereof the following words:- executive office of housing and community development.

SECTION 254. Said section 1 of said chapter 334 of the acts of 2006 is hereby amended by striking out the word “department”, wherever it appears, and inserting in place thereof the following words:- office.

SECTION 255. Section 2 of said chapter 334 of the acts of 2006 is hereby amended by striking out the word “department”, and inserting in place thereof the following words:- office.

SECTION 256. Notwithstanding any general or special law to the contrary, all petitions, executive orders, hearings and other proceedings duly brought before, and all prosecutions and legal and other proceedings duly begun on behalf of, in defense of or by the executive office of communities and development, the department of community affairs or the department of housing and community development which are pending immediately prior to the effective date of this act, shall continue unabated and remain in force notwithstanding the passage of this act, and shall thereafter be completed before or by the executive office of housing and community development.

SECTION 257. Notwithstanding any general or special law to the contrary, all orders, rules and regulations duly made, and all licenses, restrictions, permits, certificates and approvals duly granted, and all legal and decisional precedents established by or through, the executive office of communities and development, the department of community affairs or the department of housing and community development prior to the effective date of this act shall continue in force, and the provisions thereof shall thereafter be enforced, until superseded, revised, rescinded or canceled by the executive office of housing and community development.

SECTION 258. Notwithstanding any general or special law to the contrary, all books, papers, records, property, documents, equipment, lands, interests in land, buildings, facilities and other property, both personal and real, of which title or an interest therein immediately prior to the effective date of this act is in the executive office of communities and development, the department of community affairs or the department of housing and community development, are hereby transferred to the executive office of housing and community development.

SECTION 259. Notwithstanding any general or special law to the contrary, all duly existing contracts, memoranda of understanding, leases and other legal obligations of the executive office of communities and development, of the department of community affairs or of the department of housing and community development, or any instrumentality thereof which are in force or effect immediately prior to the effective date of this act, shall thereafter be performed by the executive office of housing and community development. No existing right or remedy of any character shall be lost, impaired or affected by the provisions of this act.

SECTION 260. Notwithstanding any general or special law to the contrary, any and all monies heretofore appropriated to the executive office of communities and development or any department thereof including the department of community affairs or the department of housing and community development which remain unexpended on the effective date of this act are hereby transferred to the executive office of housing and community development and shall be available for expenditure by said department for the purposes for which such funds were originally appropriated.

SECTION 261. Wherever the name of the executive office of communities and development or said department of community affairs or both, or the department of housing and community development appears in any general or special law, or in any order, rule, regulation or other document, such name shall mean and shall be construed as referring to the executive office of housing and community development.

SECTION 262. Any reference to the secretary of communities and development or to the director of department of housing and community development in any such general or special law or in any such order, rule, regulation, executive order or other document shall be deemed to be a reference to the secretary of the executive office of housing and community development. Any reference to "secretary" in any such general or special law or in any such order, rule, regulation or other document when referring to the secretary of communities and development shall be deemed to be a reference to the secretary of the executive office of housing and community development. Any reference to “director” in any general or special law or in any such order, rule, regulation or other document when referring to the director of housing and community development shall be deemed to be a reference to the secretary of the executive office of housing and community development. Any reference to "executive office" or "office" in any such general or special law or in any such order, rule, regulation, executive order or other document when referring to the executive office of communities and development shall be deemed to be a reference to the executive office of housing and community development. Any reference to "department" in any such general or special law or in any such order, rule, regulation or other document when referring to either the department of community affairs or the department of housing and community development shall be deemed to be a reference to the executive office of housing and community development.

SECTION 263. Wherever in any special or general law or in any rule or regulation there is provided a right of appeal to said executive office of communities and development or said department of community affairs or said department of housing and community development, a right of appeal to the executive office of housing and community development shall exist and such appeal shall be made pursuant to the provisions of any applicable law, rule or regulation or amendments thereto or, in the absence of such applicable law, rule or regulation.

SECTION 264. All functions, rights, obligations, powers, duties and statutory provisions which, prior to the effective date of this act, were assigned to, or exercised by, said executive office of communities and development, said department of community affairs or said department of housing and community development shall continue to be exercised and performed by, and to be assigned to, the executive office of housing and community development.

SECTION 265. All officers and employees of said executive office of communities and development, said department of community affairs and said department of housing and community development transferred to the executive office of housing and community development shall be transferred without impairment of seniority, retirement or other rights of employees, without reduction in compensation or salary grade and without change in union representation. Any collective bargaining agreement in effect immediately prior to said effective date of transfer shall continue as if the employees had not been so transferred. Nothing in this section shall be construed to confer upon any employee any right not held immediately prior to the date of said transfer, or to prohibit any reduction of salary or grade, transfer, reassignment, suspension, discharge, layoff, or abolition of position not prohibited prior to such date.

SECTION 266. Notwithstanding any general or special law to the contrary, the public housing regulations of the executive office of communities and development, of the department of community affairs or of the department of housing and community development, as codified in the Code of Massachusetts Regulations, shall remain in full force and effect until such time as the executive office of housing and community development amends, supersedes, revises, rescinds, or cancels them.

SECTION 267. The executive office of housing and community development shall succeed to all the powers and duties of the department of housing and community development and the secretary and undersecretary of the executive office of housing and community development shall exercise in their own names any power and perform any duty which is assigned the secretary of communities and development, said executive office and said department by and through chapters 3, 6, 6A, 7, 9, 10, 19A, 19D, 20, 21A, 21D, 21E, 23A, 23B, 23D, 25A, 28A, 29, 31, 40, 40A, 40B, 40C, 40D, 40F, 40H, 40O, 40R, 40S, 41, 43B, 43C, 44, 44B, 58, 61A, 62, 62C, 62E, 63, 66A, 79A, 111, 121A, 121B, 121C, 121D, 140, 151B, 161A, 184 of the General Laws, chapter 708 of the acts of 1966, chapter 708 of the acts of 1966, chapter 846 of the acts of 1974, chapter 270 of the acts of 1977, chapter 502 of the acts of 1977, chapter 327 of the acts of 1979, chapter 487 of the acts of 1980, chapter 15 of the acts of 1984, chapter 405 of the acts of 1985, chapter 637 of the acts of 1985, chapter 405 of 1987, chapter 181 of the acts of 1988, chapter 716 of the acts of 1989, chapter 133 of the acts of 1990, chapter 205 of the acts of 1992, chapter 93 of the acts of 1995, chapter 294 of the acts of 1996, chapter 301 of the acts of 1998, chapter 16 of the acts of 1999, chapter 127 of the acts of 1999, chapter 159 of the acts of 2000, chapter 46 of the acts of 2003, chapter 105 of the acts of 2003, chapter 141 of the acts of 2003, chapter 53 of the acts of 2005, chapter 52 of the acts of 2006, chapter 101 of the acts of 2006, chapter 334 of the acts of 2006 or any other provisions of law.
