An Act relative to distribution to obligors and custodial parents of quarterly statements of child support payments received by the Division of Child Support Enforcement . |
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Chapter 119A of the General Laws is hereby amended by adding the following section:—
Section 18. The IV-D agency shall provide a quarterly statement to the obligor and custodial parent which contains a full accounting for the preceding quarter relative to said obligor. Said statement shall include but not be limited to the following information: (1) the dates and amounts of each payment received by the IVD agency during the reporting period from the obligor, or any
employer or other person remitting child support payments on behalf of the obligor. (2) the distribution during the reporting period of any payments received under clause (1), including the name of the person to whom payment was made or the department of transitional assistance, if applicable, and the date and amount of such payment; and (3) detailed explanations of any collection proceedings instituted or pending during the reporting period, including the nature and date thereof, the amount, if any obtained, and whether such proceedings is pending or had been resolved.
The IV-D agency shall notify each obligor and custodial parent in writing of his/her right to receive said quarterly statements. Upon said notification an obligor and/or custodial parent may
elect not to receive said statements; provided, however, that the IV-D agency shall bear the burden of proving that such election was made after notification of the provisions of this section.
The IV-D agency shall provide an obligor and/or custodial parent, upon request at any time, a current statement containing all the aforementioned information. Said statements shall be provided within ten days of the request and for a cost not to exceed ten dollars for each statement.
