In the Year Two Thousand and Seven.

 An Act relative to the protection of those in long term care facilities.

 

    Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:


 

SECTION 1.  Section 178F.5 of chapter 6 of the General Laws is hereby amended by inserting in line nine after the word “accurate” the following language –

               

Such sex offender who is admitted to a facility as defined in section 72F of chapter 111 of the General Laws shall notify the police department of the municipality where the facility is located by telephone or in person of their admittance within twenty-four hours of their admittance.

 

SECTION 2.  Section 178K(2)(b) of chapter 6 of the General Laws is hereby amended by inserting at the end thereof the following –

 

Upon notification by an offender who has been admitted to a facility pursuant to section 178F.5 of this chapter, the police department of the municipality where the facility is located shall actively disseminate to the director of said facility the following information:

(i)                   the name of the sex offender;

(ii)                 the offense for which the offender was convicted or adjudicated and the date of the conviction or adjudication;

(iii)                the sex offender’s age, sex, race, height, weight, and eye and hair color; and

(iv)               a photograph of the sex offender, if available.

All such notices shall include a warning regarding the criminal penalties for use of sex offender registry information to commit a crime or to engage in illegal discrimination or harassment of an offender and the punishment for threatening to commit a crime under section 4 of chapter 275 of the General Laws.

 

SECTION 3.  This act shall take effect immediately.
