In the Year Two Thousand and Seven.

 An Act relative to indecent assault on a minor.

 

    Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:


 

Section 1: Chapter 265 of the Massachusetts general Laws as appearing in the 2004 Official Edition is hereby amended in Section 13B by inserting in line 6 after the words “term of years” the following: “provided further that no sentence imposed under the provisions of this section for such a second offense shall be for less than a mandatory minimum term of eighteen months; and, provided further that no sentence imposed under the provisions of this section for a third or subsequent offense shall be for less than a mandatory minimum sentence of thirty six months.”

Section 2: Section 13B of said Chapter 265 is further amended by inserting at the end thereof the following:

“Whoever intentionally exposes himself in a sexually explicit manner to a child or children under the age of fourteen shall be deemed to have committed indecent assault for the purposes of this act.  Any person who so exposes himself in location generally frequented by children such as a school bus stop or playground shall be presumed to have so exposed himself intentionally”
