In the Year Two Thousand and Seven.

 An Act relative to judgment and execution.

 

    Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:


 

SECTION 1.           Chapter 235 of the Massachusetts General Laws after section 3, add the following section:

 

                “Chapter 3A.  Notice upon defendants.”

 

“The Court shall not deem due process requirements for notice to have been met with respect to the defendant until there has been a sufficient showing that a diligent effort has been made to ascertain the most recent residential or employer address of such defendant and that written notice has been sent to the defendant at such address via certified mail and/or by in-hand service.”
