Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
Section 85K of chapter 231 of the General Laws, as appearing in the 2004 Official Edition, is hereby amended by inserting after the word “costs” in line 8 the following: — provided, however, in the case of a hospital where the tort results in death the liability in any such cause of action shall not be less than $100,000.
