An Act relative to the penalties for persons convicted of assaults in dwellings. |
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
Chapter 265 of the General Laws, as appearing in the 2004 Official Edition, is hereby amended by inserting after section 18C, the following section:--
Section 18D. Assault in Dwelling: Whoever knowingly enters the dwelling place of another and while therein commits an assault upon a person lawfully therein shall be punished by imprisonment in the state prison for not more that ten (10) years or by a fine of not more than $500 dollars and imprisonment in jail for not more than 2 years.
