An Act relative to the medical insurance of certain employees of the boston edison company. |
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Chapter 164 of the Acts of 1997 is hereby
amended by inserting after section 306 the following section:—
Section 306A. Notwithstanding the provisions of any general or special law,
rule or regulation to the contrary, the Boston Edison Company or its
organizational successors or assigns, to wit, a new corporate entity in which
BECO is enveloped shall, as of November 25, 1997,
be responsible to protect an preserve the rights of the following former BECO
non-represented nuclear employees of Pilgrim Station compensating them for
post-retirement medical insurance and their respective costs (PRMIC). Said
employees which are affected by this section are as follows:

Further,
that the BECO, and/or its corporate organizational successor as defined above
shall be responsible and shall pay compensation for the post-retirement health
insurance for those employees listed as aforesaid. The amount of compensation
itemized per employee, totaling in the aggregate THREE MILLION, THREE HUNDRED
TWENTY-NINE THOUSAND, FOUR HUNDRED NINETY-SEVEN ($3,325,497.00) DOLLARS, was
based upon the amounts established by BECO for employees to purchase
post-retirement medical insurance.
Said employees shall receive said compensation for post-retirement medical
insurance within thirty (30) days of the enactment of this amendment herein, in
one lump sum payment. The Department of Telecommunications and Energy shall
have the authority to fine said BECO and/or its successor organizational entity
as defined above, $25,000.00 per day for each day of non-compliance, in the
payment of the aforesaid post-retirement medical insurance to the employees set
forth above. There shall be no continuing plan or program to compensate the
employees any further than the single one time only payment to compensate such
employees for his/her post-retirement health cost.
The liability of said post-retirement medical insurance compensation shall
adhere to and run the owner of the interest in the organizational entity known
as BECO and not with the Pilgrim Plant site or any subsequent owner. Any new
owner of the Pilgrim Plant is expressly exempt in that the funds for said
post-retirement medical insurance were paid by the ratepayer while collected by
and retained by BECO and its corporate organizational successors as defined
herein.
Further said payments are considered a recovery of funds by the ratepayer for
such medical costs for the benefit of said employees, which funds have been
retained by the company, to prevent an unjust enrichment of said company.
SECTION 2. This act shall take effect upon its passage.
