 An Act relative to expedited permitting.

 

    Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:


 

SECTION 1:  Section 2 of chapter 43D as appearing in the 2004 Official Edition, and most recently amended by chapter 205 of the acts of 2006, is hereby further amended by inserting in the definition of “governing body” after the words “the board of selectmen” the following: --

, or as otherwise provided by local charter.

 

SECTION 2: Subsection (1) of section 2 of chapter 43D, as so amended, is hereby further amended by inserting after the words “commercially or industrially zoned” the following: --

or zoned for mixed-use development, or any combination thereof;

 

SECTION 3: Subsection (a) of section 3 of chapter 43D, as so amended, is hereby further amended by inserting after the words “town meeting in a town” the words: --

or as otherwise provided by local charter.

 

SECTION 4: Subsection (c) of section 5 of chapter 43D, as so amended, is hereby further amended by striking the words “30 days” and inserting in place thereof the words: --

20 business days.

 

SECTION 5: Subsection (a) of section 10 of chapter 43D, as so amended, is hereby further amended by striking the word “later” and inserting in place thereof the word: --

earlier.

 

SECTION 6: Subsection (b) of section 10 of chapter, as so amended, is hereby further amended by striking the words “whether or not previously a party to the proceeding” and inserting in place thereof the words: --

who has previously been a party to the proceeding.

 

SECTION 7: Subsection (d) of section 11 of chapter 43D, as so amended, is hereby further amended by striking the word “continuation of” and inserting in place thereof the word: --

continual.
