In the Year Two Thousand and Seven.

 An Act relative to controlled substances.

 

    Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:


 

   SECTION 1.  Chapter 270 of the General Laws, as appearing in the 2004 Official Edition, is hereby amended by adding the following section:

                Section 8B:  Selling confections emulating prohibited substances; prohibition.

                Whoever sells or provides to a person under the age of 18 any confection which by taste, appearance, or package substantially emulates a substance prohibited under chapter 94C of the General Laws shall be punished by a fine of not more than $5000.00 per violation.

 

SECTION 2.  Section 31 of  chapter 94C of the General Laws, as appearing in the 2004 Official Edition, is hereby amended by striking out, in line 108, the words “3,4-methylenedioxy methamphetamine (MDMA)”.

 

SECTION 3.  Clause (a) Section 31 of chapter 94C of the General Laws, as appearing in the 2004 Official Edition, is hereby amended by inserting at the end thereof the following words  “3,4-methylenedioxy methampetamine (MDMA)”.

 

SECTION 4.  Section 32E of chapter 94C of the General Laws, as appearing in the 2004 Official Edition, is hereby amended by striking in lines 81, 83, and 88 the word, “fourteen” and inserting in place thereof the word “seven”.

 

SECTION 5.  Section 32E of chapter 94C of the General Laws, as appearing in the 2004 Official Edition, is hereby amended by striking in lines 88 and 95 the word, “twenty-eight” and inserting in place thereof the word “fourteen”.
