In the Year Two Thousand and Seven.

 An Act relative to Trans Fat disclosure.

 

    Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:


 

SECTION 1. Chapter ninety-four of the General Laws, as appearing in the 2004 Official Edition, is hereby amended by deleting section 58 and inserting in place thereof the following:          

SECTION 58:  Whoever utilizes trans fatty acids, as defined by the United States Food and Drug Administration, in the preparation of food to be sold at any hotel or restaurant to a guest or patron thereof, without notifying said guest or patron by means of a printed notice on all menus or signs listing menu items, such printing to be of not less than twelve point type and located immediately adjacent to each menu item utilizing one or more trans fatty acid, shall be subject to a fine of not less than one hundred dollars for each unnoticed menu item in any calendar year.
