In the Year Two Thousand and Seven.

 An Act increasing patient protections of blood banking operations.

 

    Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:


 

SECTION 1:  Section 184B of Chapter 111 of the general laws, as appearing in the 2004 official edition, is hereby amended by striking out the first full paragraph and inserting in place thereof the following paragraph:

No blood bank, so-called, shall be established and maintained in the commonwealth unless so licensed by the department of public health pursuant to regulations promulgated by said department.

 

Section 2:  Application of this Act

The Commissioner of the Massachusetts Department of Public Health shall convene an advisory committee of interested parties to assist in any needed changes to blood bank regulations.  The committee shall include the Commissioner or his designee, a representative from the Massachusetts Hospital Association, a representative from the Massachusetts Medical Society, a representative from the Board of Registration in Medicine, a representative from the American Red Cross, and such other representatives as the Commissioner deems appropriate.
