Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Section 121 of Chapter 140 of the General Laws as so appearing in the 2002 Official Edition is hereby amended by inserting after the word “powder” in line 8 the following except pepper spray.
SECTION 2. Section 129B of Chapter 140 of the General laws as so appearing in the 2002 Official Edition is hereby amended by striking the words “pepper spray” in line 142.
SECTION 3. Subsection (c) of Section 129B of Chapter 140 of the General Laws is further amended by inserting after the fourth sentence the following sentence: a firearm identification card shall not be necessary for the purchase, possession or usage of pepper spray.
A person shall be of eighteen years of age and older to purchase, possess or use pepper spray.
SECTION 4. Section 129B of Chapter 140 of the General Laws is further amended by striking the words “pepper spray” from line 184.
SECTION 5. Section 131 of Chapter 140 of the General Laws as so appearing is hereby amended by striking the words “pepper spray” from line 95.
SECTION 6. Subsection (6) of Section 131 of Chapter 140 of the General Laws as so appearing is hereby amended y adding the following sentence: Neither license shall be required for the purchase, possession or usage of pepper spray.
SECTION 7. Section 131P of Chapter 140 of the General Laws as so appearing is hereby amended by striking the words “pepper spray” from line 14.
