An Act relative to retirement benefits of certain state police and corrections officers. |
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Section 40 of chapter 15A of the General Laws, as appearing in the 2002 Official Edition, is hereby amended by inserting after the figure “32” in line 73, the following words:--
“And state police officers as described in section 26 of chapter 32, and correction officers as set forth in section 28M of said chapter 32.”
SECTION 2. Paragraph (b) of subsection (2) of said section 40 of said chapter 15A, as so appearing, is hereby amended by adding the following clause:--
“(v) Any state police officer or correction officer who is a retired member of a retirement system established under the provisions of chapter 32 may elect in writing to participate in the optional retirement program within 90 days of the effective date of the appointment. Any such election shall be effective as of the effective date of appointment. Nothing contained herein shall prevent such officer from both receiving retirement benefits from a retirement system established under chapter 32 and from participating in and receiving benefits from the optional retirement system set forth in this section.
SECTION 3. Section 26 of chapter 32 of the General Laws as appearing in the 2002 Official Edition, is hereby amended by adding the following subsection:--
“(6) Notwithstanding the provisions of section 91 or any other law to the contrary, a state police officer or a correction officer while receiving a pension, disability pension or retirement allowance from the Commonwealth may, after the date of his retirement, be paid for services rendered to the Commonwealth as a teacher in a state college or community college and may, at his discretion, participate in the optional retirement program described in section 40 of chapter 15A. Nothing contained herein shall prevent such officer from both receiving benefits from the optional retirement system established under section 40 of chapter 15A.”
