 An Act protecting government units in retirement systems.

 

    Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:


 

SECTION 1. Section 11 of Chapter 32 of the General Laws is hereby amended by inserting the following subparagraph in paragraph (1):

 

(d) If a member is entitled to a return of his accumulated total deductions and requests such a return from the board on the proscribed form, prior to the return of such accumulated total deductions, the board shall contact such member’s employer to determine whether such member owes any obligation to the employer under the terms of a cafeteria style health plan.  If it is determined that the member owes the employer under the terms of such a plan, the board shall not return the accumulated total deductions until it has received notice from the employer that the obligation has been satisfied.
