In the Year Two Thousand and Seven.

 An Act relative to the state pension system.

 

    Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:


 

SECTION 1.           Chapter 32 of the General Laws, as appearing in the 2004 Official Edition, is hereby amended by adding the following new section:

 

section 39          Within 30 days of the death of a person receiving state retirement benefits, an executor, beneficiary, next of kin or a family member is required to provide the office of the treasurer notice of the death including: the member's name, current address, Social Security number or retirement number, date of death and the prospective beneficiary's name, address, and telephone number; or the name, address, and telephone number of the person handling the deceased member's affairs.

 

                Within 60 days of notification by an executor, beneficiary or a family member of a member’s death, the office of the treasurer will provide the appropriate survivor or survivors with information regarding survivor benefits and application requirements or notify the survivor or survivors that no survivor benefits are available.

 

                Failure to notify the office of the treasurer within 30 days of death such will result in a fine of $500.

 

                The office of the treasurer is authorized to notify the attorney general or other law enforcement agency of violations of the section for proper prosecution
