Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Section 9B of Chapter 30 of the General Laws, as appearing in the 1994 Official Edition, is hereby amended by inserting after the word “thirty-one”, in line 14, the words:— provided however, that for any such person covered by a collective bargaining agreement that addresses the issues herein, the collective bargaining provisions relating to reduction in force, promotion and the filling of vacancies shall take precedence over the provisions of this paragraph and provided further the employee shall have a choice between said collective bargaining provisions and provisions herein regarding discharge, removal, suspension, being transferred without assent, being laid off or lowered in rank or competition for reasons other than reduction in force, promotion or filling of vacancies.
