In the Year Two Thousand and Seven.

 An Act distributing more child support to children.

 

    Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:


 

SECTION 1.  Subsection (b) of section 2 of chapter 119A of the General Laws is hereby amended by adding at the end thereof the following:

 

In accordance with the foregoing and notwithstanding any general or special law to the contrary, the Commonwealth shall exercise the options under 42 U.S.C. § 657 with respect to current and former recipients of assistance under Title IV, Parts A and E to: (i) cease requiring an assignment of support arrears that accrued before the family began receiving assistance; (ii) discontinue prior assignments of child support to the extent permitted by federal law; and (iii) pay child support collections to satisfy amounts owed to the family before applying the collection to pay arrears assigned to the state; provided further, that in the case of a family receiving assistance, to the extent that the federal government will waive the federal share of a child support collection, the Commonwealth shall pay the child support to the family and shall disregard such payment in determining the amount of assistance provided to the family.

 

SECTION 2. Notwithstanding any general or special law to the contrary, the department of revenue shall submit a report on or before February 1, 2008 to the chairs of the house and senate committees on ways and means and the chairs of the joint committee on revenue setting forth in detail the steps the department has taken and plans to take to implement section 1 effective October 1, 2008; provided further, that said report shall include a timetable for accomplishing each of the steps the department determines is necessary to implement section 1 effective October 1, 2008.

 

SECTION 3. Section 1 shall take effect on October 1, 2008.
