Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Subsection (j) of section 89 of chapter 71 of the General Laws, as appearing in the 2002 official edition, is hereby amended by striking the existing language and inserting in place thereof the following: to make contracts and leases for the procurement of services, equipment and supplies, provided that if the charter school intends to procure substantially all educational services under contract with another person such contract must be awarded subject to the competitive bidding procedures of chapter 30B of the General Laws, as appearing in the 2002 official edition, and provided further that the terms of such contract must be approved by the board either as part of the original charter or by way of an amendment thereto; provided further that the board shall not approve any such contract terms, the purpose or effect of which is to avoid the prohibition of this section against charter school status for private and parochial schools.
