Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
Section 39S of Chapter 30 of the General Laws, as inserted by Chapter 306 of the Acts of 2004, is hereby amended by striking out subsections (b) and (c) and inserting in place thereof the following two subsections: -
(b) Any employee who has not successfully completed a 10 hour course in construction safety and health approved by the United States Occupational Safety and Health Administration shall not be eligible to perform work on public construction projects in the Commonwealth.
(c) The office of the attorney general shall have the power to enforce the provisions of this act, including the power to institute and prosecute proceedings in superior court, as warranted based on the level of infraction. All enforcement actions carried out herein shall be commensurate with the level of infraction, with due consideration given as to whether there was a willful intent to violate the provisions of the act.
