In the Year Two Thousand and Seven.

 An Act relative to the establishment of a pay as you save program in the Commonwealth.

 

    Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:


 

SECTION 1.  Not withstanding any General Law, Special Act, rule or regulation to the contrary, the Commonwealth shall establish a Pay-As-You-Save (PAYS) pilot project.  The project shall allow building owners and tenants to purchase and install renewable energy products with no up-front payment or debt commitment.  Instead, the owner or tenant’s energy supplier, a third-party capital provider or product vendor shall provide the up-front capital to purchase the equipment, and shall be repaid through a charge that shall be added to owner or tenant’s utility bills for as long as the owner or tenant occupies the building or until all debts are paid.  Should the owner or tenant vacate the building, the charge will pass to the next owner or tenant.

 

SECTION 2.  The PAYS charge shall be treated like any utility charge, and non-payment by an owner or tenant can result in disconnection.  The capital provider shall also be allowed to recover bad debt.
