An Act Prohibiting driving under the influence while operating snowmobiles, all terrain vehicles and other recreational vehicles.

    Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1.           Section 8 of chapter 90B of the General Laws, as

appearing in the 2002 Official Edition, is hereby amended by inserting in

line 1 after the word “water” the following words:-  , or any snowmobile, all

terrain vehicle, or any other recreational vehicle on the lands

SECTION 2.           Said section 8 is further amended by inserting in line 5

after the  word “vessel” the following words:- , or any snowmobile, all

terrain vehicle, or any other recreational vehicle

SECTION 3.           Said section 8 is further amended by inserting in line 169 after the

SECTION 46.         Chapter 90B of the General Laws, as appearing in the

2002 Official Edition, is hereby amended by inserting after Section 8B the

following new section: 

Section 8C.                            Notwithstanding the provisions of any General or special law to the contrary, or any rule or regulation to the contrary, the provisions of sections 8, 8A and 8B shall apply to the operation of  snowmobile, all terrain vehicle, or any other recreational vehicle on any and all public and private land in the commonwealth.

SECTION 47.         Section 9 of chapter 90B, as appearing in the 2002

Official Edition, is hereby amended by inserting in line 1 after the word

“motorboat” the following words:- , or any snowmobile, all terrain vehicle,

or any other recreational vehicle

SECTION 48.         Said section 9 is further amended by inserting in line 3
