Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Section 24 of chapter 90 of the General Laws, as appearing in the 2002 Official Edition, is hereby amended by striking out, in lines 361 to 370, inclusive, lines 389 to 399, inclusive, lines 416 to 425, inclusive, the words “and the registrar may, in his discretion, issue such license under such terms and conditions as he deems appropriate and necessary; and provided, further, that such person may, after the expiration of one year from the date of conviction, apply for and shall be granted a hearing before the registrar for the purpose of requesting the issuance of a new license on a limited basis on the grounds of hardship and a showing by the person that the causes of the present and past violations have been dealt with or brought under control and the registrar may, in his discretion, issue such a license under such terms and conditions as he deems appropriate and necessary” and inserting in place thereof the following words:- or if such person is on probation and is in compliance with the terms and conditions of probation, or if such person has successfully completed probation and has not been convicted or found responsible of any civil or criminal motor vehicle violations since the date of the underlying conviction which caused said license to be suspended, and said person agrees to have an ignition interlock device installed in their motor vehicle at their own expense which shall prevent the motor vehicle from starting if said persons breath alcohol level is greater than .02, said registrar shall issue such license; and provided, further, that such person may, after the expiration of one year from the date of conviction, apply for and shall be granted a hearing before the registrar for the purpose of requesting the issuance of a new license on a limited basis on the grounds of hardship and a showing by the person that the causes of the present and past violations have been dealt with or brought under control by meeting the above requirements, then the registrar shall issue such a license.
SECTION 2. Said section 24 of said chapter 90, as so appearing, is hereby further amended by striking out subparagraph (3 3/4).
