 An Act fees charged by notaries public.

 

    Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:


 

SECTION 1.  Chapter 222 of the General Laws, as appearing in the 2004 Official Edition, is hereby amended by inserting after section 1 the following new section:--

 

Section 1A. Except as otherwise provided in section 41 of chapter 262, the maximum fees that may be charged by a notary public for performing notarial acts are:

   (a) For acknowledgements, $25 per signature.

   (b) For oaths or affirmations without a signature, $25 per person.

   (c) For oaths or affirmations with a signature, $25 per signature.

 

SECTION 2. Chapter 262 of the General Laws, as so appearing, is hereby amended by striking out section 41 and inserting in place thereof the following new section:--

Section 41. The fees of notaries public shall be as follows:

For the protest of a bill of exchange, order, draft or check for non-acceptance or non-payment, or of a promissory note for non-payment, if the amount thereof is $500 or more, $10; if it is less than $500, $7; for recording the same, $2; for noting the non-acceptance or non-payment of a bill of exchange, order, draft or check or the non-payment of a promissory note, $10; and for each notice of the non-acceptance or non-payment of a bill, order, draft, check or note, given to a party liable for the payment thereof, $5; but the whole cost of protest, including necessary notices and the record, if the bill, order, draft, check or note is of the amount of $500 or more, shall not exceed $10, and if it is less than $500, shall not exceed $7; and the whole cost of noting, including recording and notices, shall in no case exceed $5.
