Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
Chapter 138 of the General Laws is hereby amended by inserting after section 34D the following section:-
Section 34E. A licensee may consign alcoholic beverage to a duly licensed common carrier for the purpose of delivery within the commonwealth; provided that (1) the licensee enters into a written contract with such common carrier, which contract provides that the common carrier will deliver only to a natural person who presents reasonable evidence of being 21 or over at the time of such delivery; (2) the common carrier agrees in said written contract not to deliver any alcoholic beverages to any location within the commonwealth unless a natural person over the age of 21 who provides evidence of age as aforesaid is present to receive the delivery; and (3) any alcoholic beverages consigned to a common carrier by a licensee shall be consigned only in boxes or cartons that have the following words prominently written upon such box or carton: “CONTAIN ALCOHOLIC BEVERAGES AND MAY ONLY BE DELIVERED TO A PERSON OVER THE AGE OF 21 WHO PRESENTS REASONABLE EVIDENCE OF SUCH AGE”; then
1) The licensee shall have no liability under any law or statue of the commonwealth arising from such common carrier’s delivery to or possession by a minor of alcoholic beverages; and
2) The licensee’s license shall not be subject to suspension, r evocation, or any other action arising from such common carrier’s delivery to or possession by a minor of alcoholic beverages.
