 An Act relative to the issuance of an all alcohol beverage license in the city of Easthampton

 

    Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:


 

Notwithstanding the provisions of section seventeen of Chapter one hundred and thirty-eight of the General Laws, the licensing authority of the city of Easthampton is hereby authorized to issue One Northampton Street Enterprise Inc., an additional license for the sale of all alcoholic beverages to be drunk on the premises under the provisions of section twelve of said chapter one hundred and thirty-eight. Said license shall be subject to all provisions of said chapter one hundred and thirty-eight except said section seventeen, provided, however, that the licensing authority shall not approve the transfer of said license to any other person, organization or corporation or location other than the historic building located on the property 1 Northampton Street/Map 51, Lot 29, and known as "Old Memorial Hall".

 

The applicant has a period of three years in which to apply for the awarded license from the Easthampton licensing authority. The three year time period begins when the Easthampton licensing authority receives the license from the Legislature.  If the applicant has not applied for the license within three years, the license remains with the local licensing authority and can be re-issued to the same location.

 

A license issued under this section, if revoked, surrendered, or no longer in use, shall be returned to the Easthampton licensing authority. The Easthampton licensing authority then may grant that license to new applicant at the same location so long as the applicant meets the criteria set forth in this act.
