In the Year Two Thousand and Seven.

 An Act relative to a certain reserve fund in the town of Oak Bluffs.

 

    Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:


 

SECTION 1. Chapter 234 of the acts of 1994 is hereby repealed.

 

SECTION 2. Notwithstanding any general or special law to the contrary, the town of Oak Bluffs may continue the operation of a reserve fund in which all monies received from the provision of ambulance services shall be deposited.  The town treasurer shall keep all funds deposited and all funds presently held in said fund, separate and apart from all other monies.

 

SECTION 3. The reserve fund shall be used for the purchase and equipping the public safety vehicles with a priority for ambulance and police and fire department vehicles and for the payment of emergency medical technicians and paramedics and for the compensation for ambulance transfers outside of Dukes County.  Purchases of public safety vehicles shall be authorized by a majority vote at an annual or special town meeting.  The payment of compensation to emergency medical technicians and paramedics or equipment purchases from the reserve fund may be authorized by the board of selectmen or its designee.

 

SECTION 4. Any actions and proceedings taken by the town of Oak Bluffs in connection with the reserve fund established by chapter 234 of the acts of 1993 prior to the effective date of this act are hereby ratified, validated and confirmed to the same extent as if such actions and proceedings had been in full compliance with law.

 

SECTION 5. This act shall take effect upon its passage.
