In the Year Two Thousand and Seven.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
Section 1. Notwithstanding the provisions of Chapter 887 of The Acts of 1977, An Act Relative to the Granting of Licenses for the Sale of All Alcohol Beverages at Certain Restaurants in the Town of Arlington, or any other special act or general law to the contrary, the Selectmen of the Town of Arlington shall cause to be placed on the official ballot used in the Town of Arlington by the registered voters thereof at the Annual Town Election to be held in the year 2008 the following question:
Shall the Board of Selectmen be granted the authority to reduce from 99 to 50 the minimum seating capacity for restaurants and function rooms for the sale therein of all alcohol beverages to be consumed on the premises?
Yes ________ No ________
If a majority of the votes cast in said Town in answer to said question is in the affirmative, said Town shall be taken to have authorized the sale in said Town of all alcoholic beverages to be drunk on the premises for not more than ten restaurants and function rooms having a seating capacity of not less than fifty persons.
Said licenses shall be subject, however, to all the other provisions of said Chapter one hundred and thirty-eight.
Section 2. The Board of Selectmen of the Town of Arlington is hereby authorized to and shall include a summary of the aforesaid question to be printed on the ballot along with the question as stated in section one and to print said summary.
Section 3. This act shall take effect upon its passage.”
