Be it enacted by the Senate and House
of Representatives in General Court assembled, and by the authority of the
same, as follows:
SECTION 1. Notwithstanding the provisions of section 17 of chapter 138 of the General Laws, the licensing authority of the town of Aquinnah may grant to restaurants including restaurants within inns and hotels with seating capacities of not less than 15 seats for the sale of wine and malt beverages to be drunk on the premises under section 12 of said chapter 138. Such licenses shall be subject to all of said chapter 138 except said section Such wine or malt beverage shall be served by a waitperson only at a dining table with a meal. The licensing authority may from time to time issue rules and regulations for the issuing of such licenses and to carry out the purposes of this act. Such licenses may be issued seasonably or annually.
SECTION 2. Notwithstanding sections 11 and 11A of chapter 138 of the General Laws or any other general or special law to the contrary, the board of selectmen shall cause to be placed on the ballot at a regular or special election the following question:-
“Shall an act passed by the General Court in the year 2007 entitled ‘An Act Authorizing the Town of Aquinnah to issue licenses for the sale of wine and malt beverages to be drunk on the premises in restaurants’ be accepted?”
If the majority of votes cast in answer to the question is in the affirmative, the town shall be taken to have authorized the granting of licenses for the sale of wine and malt beverages to be drunk on the premises.
SECTION 3. This act shall take effect upon its passage.
